REGISTERED CLUBS ACT 1976—REGULATION
(Relating to records and returns in respect of poker machines)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Registered Clubs Act 1976, has been pleased to make the Regulation set forth hereunder.

Commencement
1. (1) This Regulation commences on the date on which it is published
in the Gazette, except as provided by subclause (2).
(2) Clause 2 (b) and (e) commence on 21 July 1991.
Amendments
2. Schedule 2 to the Registered Clubs Regulation 1983 is amended:
(a) by omitting clauses 7 and 9 and Appendix D;
(b) by inserting after clause 6 the following clause: Records
7. (1) The registered club is to make, on or before the 21st day in each month commencing on 21 July 1991, with respect to each poker machine kept by the club, a record in or to the effect of Appendix B or C to this Schedule relating to the previous month and to that part of the previous 12 months for which information. is available.

(2) Each record is to be:
(a) examined by the club's board or committee; and(b) certified by an officer of the club to be accurate,
within 1 month after the last date on which the record was
required to be made.(3) The registered club is to retain each record for a period of not less than 3 years after the last date on which it was required to be made.
| (c) | by omitting from clause 7A the words "under this Part" and by inserting instead the words "under Part 4B of this Regulation"; |
(d) by inserting at the end of clause 7A the following subclause:
(2) The registered club is to retain a copy of each return lodged
under section 86 (2) of the Act for a period of not less than 3
years after the date on which it was lodged.
(e) by omitting clause 8.
EXPLANATORY NOTE
The object of this Regulation is to amend the Registered Clubs Regulation 1983:
| (a) | to remove special provisions requiring registered clubs, as a condition of their registration, to lodge with the Liquor Administration Board monthly returns in respect of poker machines, although certified monthly records must still be kept; and |
| (b) | to require the clubs to keep, for at least 3 years, copies of each return relating to poker machine performance and duty payable required to be lodged under section 86 of the Registered Clubs Act 1976; and |
| (c) | to remove the provision that allows certain registered clubs to read and |
