REGISTERED CLUBS ACT 1976—REGULATION

(Relating to late payment of registration fee instalments)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Registered Clubs Act 1976, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 16 January 1992.

Amendments

2. The Registered Clubs Regulation 1983 is amended:

(a) by omitting clause 19 (2)–(5) and by inserting instead the
following subclauses :

(2) The penalty for a failure to pay by the due date an instalment of registration fee payable in respect of the registration period that commences on 16 January 1992 or any subsequent registration period is:

(a) $250; and

(b)

0.15 percent of the amount of the instalment for each day by which the payment is late.

(3) If an instalment is not paid within 2 months after the due

date, the certificate of registration is cancelled.

(4) A penalty resulting from a failure to pay an instalment by the due date may be recovered by the Board as a debt due to the Crown.

(b) by omitting clause 19 (8) and clauses 19A and 19B.

EXPLANATORY NOTE

The object of this Regulation is to amend the Registered Clubs Regulation 1983:

(a) to vary the provisions relating to penalties for late payment of an instalment of registration fee; and
(b) to repeal clauses 19A and 19B (relating to the effect on trading of certain natural disasters), the operation of which is spent.

At present, late payment of an instalment of registration fee attracts a lump sum penalty of $100 and, in addition, an amount calculated at 0.15 per cent of the amount of the instalment, A club’s certificate of registration may be cancelled if this penalty is not paid within 1 month after the instalment is paid or within 3 months after the due date for payment of the instalment (whichever is earlier).

The effect of the amendments is that, in relation to registration periods

commencing on or after 16 January 1992:

the lump sum component of the penalty will be increased from $100 to $250; and
a failure to pay the penalty will not result in automatic registration cancellation, but the mount of the penalty may be recovered as a debt due to the Crown.
