REGISTERED CLUBS ACT 1976—REGULATION

(Relating to duty on poker machines and the types of poker machines that

may be used)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Registered Clubs Act 1976, has been pleased to make the Regulation set forth hereunder.

The Registered Clubs Regulation 1983 is amended:

(a) by inserting after clause 20L the following clause:

Prohibition on use of certain poker machines

20LA. A poker machine on which player interactive draw poker, or some other player interactive game derived from draw poker, can be played may not be operated on the premises of any registered club and such a poker machine is prescribed as having ceased to be an approved poker machine for the purposes of paragraph (b) of the definition of “approved poker machine” in section 4 (1) of the Act.

(b) by omitting clause 2 (2) from Schedule 2.

EXPLANATORY NOTE

The object of this Regulation is to mend the Regstered Clubs Regulation 1983 in 2 respects.

Firstly, the amendments prohibit the operation on the premises of registered clubs of poker machines on which player interactive draw poker, or some other player interactive game derived from draw poker, can be played, and prescribe such machines as having ceased to be approved machines for the purposes of the Regulation.

Secondly, the amendments omit a redundant provision from Schedule 2

(Conditions to which certificate of registration is subject) dealing with the

deductions that may made from poker machine revenue for taxation purposes be
under the Gaming
and Betting (Poker Machines) Taxation Act 1956.

The provisions of that Act have now been supplanted by Part 4B of the Regulation (dealing with duty on poker machines).

This Regulation is made under the Registered Clubs Act 1976, including sections 4 (as refe rred to in the Regulation), 73 (the general regulation making power) and
85 (Duty on poker machines).
