Notices) Regulation 2000

Registered Clubs Act 1976

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Registered Clubs Act 1976.

Explanatory note
Section 57 (2) of the Registered Clubs Act 1976 makes it an offence for a minor to provide false or misleading information in order to obtain documentary evidence relating to proof of age (such as a driver licence or “proof of age” card). Section 57 (3) of that Act makes it an offence for a person to knowingly provide or certify false or misleading information to enable another person to obtain documentary evidence relating to proof of age.
The object of this Regulation is to increase the penalty payable by a minor who has been served with a penalty notice for an offence under section 57 (2) or (3) of that Act from 0.5 penalty units (currently $55) to $110 and to fix at $55 the penalty payable by minors for all other penalty notice offences.
This Regulation is made under the Registered Clubs Act 1976, including sections

66 (penalty notices) and 73 (the general regulation-making power).

1     Name of Regulation

This Regulation is the Registered Clubs Amendment (Penalty Notices)

Regulation 2000.

2 Commencement

This Regulation commences on 3 March 2000.

3 Amendment of Registered Clubs Regulation 1996

The Registered Clubs Regulation 1996 is amended as set out in

Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

Clause 51 Penalty notice offences

Omit clause 51 (b) (ii).
Insert instead:

(ii)        in the case of a penalty notice served on a

minor:

(A) in respect of an offence under section 57
(2) or (3) of the Act—$110, or
(B) in respect of an offence under any other
provision of the Act—$55.
