An Act to enable the Registrar-Generat to supply certain deficiencies

ilz the Register Book.

[Assented to, 15th October, 1875.1

HEREAS under the '' Real Property Act of 1861," it is

W required that certificates of title shall be in duplicate, and

that one of' such certificates shall be bound up in a book called the

'L Register Book," and that the other shall be delivered to the

proprietor entitled to the land, described therein; and it is also required that the particulars of every dealing affecting the land included in a certificatc of title in the hands of a proprietor shall be entcred upon the,folium of the register book representing such certificate of title: And whereas it is provided by the said Act, that in the event of a certificate of title delivered to a proprietor being lost, mislaid, or destroyed, the Registrar-General may issue

a provisional ccrtifieate of title, and that such provisional certificate

shall be an exact copy of the certificate bound up in the register book, arld shall be as valid to all intents as the certificate lost, mislaid, or destroyed; but no provision is made in the said Act for the loss or destruction of a foliurn of the register book representing the certificate delivered to the proprietor: And whereas two foliums of Register Book CCII., numbered rcspcctively 101 and 214, have been lost, mislaid, or destroyed, and therefore there is no folium in the register book upon which to enter the particulars aforesaid, and the proprietors or holders of the duplicate certificates arc therefore unable to deal with the land described therein-Be it therefore Enacted by the Governor of the Province of South Australia, with the advice and consent of the Legislative Council

1. I t shall be lawful for tbe Registrar-General to prepare, or cause to be prepared, two folium of Register Book CCII., numbered respectively 101 and 214, and thereon inscribe, or cause to be inscribed, the certificates of title bvhich were inscribed on the original foliums, numbered respectively 101 and 214, so lost, mislaid, or destroyed, a i d to sign and seal such certificates, and to bind up the foliums in the register book in which they would have been bound up if they had not been so lost, mislaid, or destroyed; and each of such certificates of title &all be an exact copy of its duplicate delivered to the proprietor, and shall be as valid, to all intents and purposes, and capable of receiving the same endorse- ments, or memorials, or entries, required by the said Act, as if it had been originally bound up in the register book.
