Regional Infrastructure Development

Fund (Amendment) Act 2003†

The Parliament of Victoria enacts as follows:

1. Purpose

The main purpose of this Act is to amend the facilitate the extension of reticulated natural gas in regional Victoria and parts of municipal districts on the rural fringe of metropolitan Melbourne.

2. Commencement

(1) Subject to sub-section (2), this Act comes into

operation on a day to be proclaimed.

(2) If this Act does not come into operation before

1 July 2003, it comes into operation on that day.

3. Consequential amendment of definition

See:

In section 3 of the Regional Infrastructure Act No.
Development Fund Act 1999, in paragraph (a) of 64/1999 and
amending Act
the definition of "regional Victoria" for "the No. 11/2002.

4. Application of the Fund for reticulated natural gas

In section 5(1) of the Regional Infrastructure

Development Fund Act 1999—

(a) after paragraph (a)(iv) insert—

"(iva) the extension of reticulated natural gas
to and within regional Victoria and the
municipal districts of the municipal

councils set out in Schedule 2;";

(b) after paragraph (a) insert—

"(ab) to be used to provide financial

assistance for the development and
implementation of natural gas extension
projects in regional Victoria and the
municipal districts of the municipal

councils set out in Schedule 2;".

5. Municipal Councils in regional Victoria

In the Schedule to the Regional Infrastructure

Development Fund Act 1999—

(a) for "SCHEDULE" substitute
"SCHEDULE 1";

(b) after "MUNICIPAL COUNCILS" insert
"IN REGIONAL VICTORIA";

(c)

after "Baw Baw Shire Council" insert "Benalla Rural City Council";

(d) omit "Delatite Shire Council";

(e)

after "Macedon Ranges Shire Council" insert "Mansfield Shire Council".

6. New Schedule 2 inserted

After the Schedule to the Regional
Infrastructure Development Fund Act 1999

insert—

"SCHEDULE 2

OTHER MUNICIPAL COUNCILS

Cardinia Shire Council
Casey City Council
Hume City Council
Melton Shire Council
Mornington Peninsula Shire Council
Nillumbik Shire Council
