REGIONAL DEVELOPMENT COMMISSIONS AMENDMENT

REGULATIONS 1997

Made by the Governor in Executive Council.

Citation

1.     These regulations may be cited as the Regional Development

Commissions Amendment Regulations 1997.

Principal regulations

2. 1994* are referred to as the principal regulations. In these regulations the Regional Development Commissions Regulations

[* Published in Gazette 1 March 1994, p. 779-82.1

Regulations 2 to 10 repealed and substituted and a transitional provision

3.     (1) Regulations 2, 3, 4, 5, 6, 7, 8, 9 and 10 of the principal regulations

are repealed and the following regulation is substituted -

"

Appointed members of Boards

2.    For the purposes of section 15 (1) (b) of the Act, the board of

management of a commission is to have 9 appointed members of

whom -

(a) 3 are to be persons who are resident in the commission's

region and nominated in accordance with regulation 11;

(b) 3 are nominated by local governments in that region in

accordance with regulation 12; and

(c) 3 are to be appointed at the Minister's discretion.

(b) 3 (b), 4 (b), 5 (b), 6 (b), 7 (b), 8 (b), 9 (b) and 10 (b)" and substituting the

following -

Regulation 12 amended

5. (1) Regulation 12 (1) of the principal regulations is amended by

substituting the following -	deleting "2 (c), 3 (c), 4 (c), 5 (c), 6 (c), 7 (c), 8 c), 9 (c) and 10 (c)" and
" 2(b)

the board of management of the Gascoyne Development Commission, the (2) From the commencement of these regulations until the 1 July 1997, Great Southern Development Commission or the South West Development Commission is not to be taken to be improperly constituted due to the fact that it does not comply with regulation 2 of the principal regulations if it complies with regulation 2, 4 or 9 (whichever is relevant) of the principal regulations as in force before the commencement of these regulations.

Regulation 11 amended

4.      Regulation 11 (1) of the principal regulations is amended by deleting "2

by deleting government authorities or wards" and substituting in both places (2) Regulation 12 (1) (a) and (b) of the principal regulations is amended

the following —

" gov, rnments ".

deleting "authorities or wards" and substituting the following — (3) Regulation 12 (1) (a) of the principal regulations is amended by

" local governments ".

"government authorities and/or wards" and substituting the following — (4) Regulation 12 (2) of the principal regulations is amended by deleting

governments ".

deleting "authorities or wards" and substituting the following — (5) Regulation 12 (2) (i) of the principal regulations is amended by

" local governments ".
