Referendums Amendment Regulations 2004

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Referendums Amendment
Regulations 2004.

2.             The regulations amended

The amendments in these regulations are to the Referendums
Regulations 1984*.

3. Regulation 2 repealed
Regulation 2 is repealed.

4.             Regulation 3 amended

Regulation 3 is amended by deleting “Chief Electoral Officer” and inserting instead —

“ Electoral Commissioner ”.

5.             Regulation 4 amended

Regulation 4 is amended by deleting “the Appendix.” and inserting instead —

“ Schedule 1. ”.

6.             Regulation 5 replaced

Regulation 5 is repealed and the following regulation is inserted instead —

5.             Ballot papers — Retail Trading Hours Act 1987

For the referendums under the Retail Trading Hours Act 1987 section 43 the ballot papers that may be used by an elector shall be on one piece of paper in the form of Form 2 in Schedule 1.

7.             Appendix replaced by Schedule 1

The Appendix is repealed and the following Schedule is inserted instead —

(1) Insert here —

(a)

in the case of a referendum as to a Bill, a reference to the Order in Council made under the Constitution Act 1889 fixing the day for taking of the votes of the electors for the purposes of a referendum as to the Bill; or

(b)

in the case of a referendum other than a referendum as to a Bill, the title of the Act by which the referendum is authorised or required.

(2) Insert here —

(a)

in the case of a referendum as to a Bill, the title of the Bill and add “the text of which is attached” or “a statement of which is attached” as the case requires; or

(b)

in the case of a referendum other than a referendum as to a Bill, a statement as to the question to be submitted to the electors.

(3) If the Referendums Act 1983 section 5(3) applies, delete this and insert —

(a)

“Under ........... [refer to the Order in Council made under the Constitution
Act 1889 fixing the day for taking of the votes of the electors for the purposes
of a referendum as to the Bill] ....... the day fixed for the taking of the votes

in the case of a referendum as to a Bill: or

(b)

in the case of a referendum other than a referendum as to a Bill: authorised or required] ....... the day fixed for the taking of the votes of the electors is Saturday, ............................................................. 20............”.
