s1 3 s3 Recreation Areas Management (Fraser and No. 311, 1996 Moreton Islands) Amendment (No. 1) ˙ Short title 1. This by-law may be cited as the Recreation Areas Management (Fraser and Moreton Islands) Amendment By-law (No. 1) 1996 . ˙ By-law amended 2. This by-law amends the Fraser Island Recreation Area By-law 1991 . ˙ Replacement of ss 1–3 3. Sections 1 to 3— omit, insert— ˙ ‘ Short title ‘ 1. This by-law may be cited as the RecreationAreasManagementBy-law 1991 . ˙ ‘ Application ‘ 2. This by-law applies to the following recreation areas— (a) the Fraser Island recreation area; (b) the Inskip Peninsula recreation area; (c) the Moreton Island recreation area. 1 ˙ ‘ Definitions ‘ 3. In this by-law— “camp” includes— (a) stay overnight; and (b) pitch, place or erect a camping structure to camp; and (c) place other camping equipment in position. 1 A copy of the plans of these areas may be inspected, free of charge, at the department’s office at 160 Ann Street, Brisbane.
s4 4 s4 Recreation Areas Management (Fraser and No. 311, 1996 Moreton Islands) Amendment (No. 1) “camping structure” includes a vehicle or vessel that is being used, or can be used, for overnight shelter or accommodation. “notice” includes a pictorial sign or symbol erected by the board to indicate— (a) the presence of facilities; or (b) restrictions or prohibitions under the Act on persons in a recreation area. “transport law” means— (a) the Traffic Act 1949 ; or (b) the Transport Infrastructure (Roads) Act 1991 ; or (c) the Transport Operations (Road Use Management) Act 1995 ; or (d) a corresponding law of another State.’. ˙ Amendment of s 4 (Access) 4.(1) Section 4, ‘the Recreation Area’— omit, insert— ‘a recreation area’. (2) Section 4— insert— ‘Maximum penalty—20 penalty units. ‘ (2) Subsection (1) does not apply to— (a) the Inskip Peninsula recreation area; or (b) a commercial tour operator, or anyone else travelling under a commercial tour operator’s permit; or (c) a person travelling in a service permit holder’s vehicle while it is in a recreation area under the permit.’.
s5 5 s7 Recreation Areas Management (Fraser and No. 311, 1996 Moreton Islands) Amendment (No. 1) ˙ Amendment of s 5 (Camping) 5.(1) Section 5(1)— omit, insert— ‘ 5.(1) A person must not camp in a recreation area unless the person is camping in the area under a permit or a written approval given by the board.’. (2) Section 5(2), ‘the Recreation Area’— omit, insert— ‘a recreation area’. (3) Section 5(3)— insert— ‘Maximum penalty—20 penalty units.’. ˙ Amendment of s 6 (Fire bans) 6.(1) Section 6, ‘in the Recreation Area’— omit, insert— ‘in a recreation area’. (2) Section 6(1), ‘the Recreation area for such time as’— omit, insert— ‘a recreation area for the time’. (3) Section 6(2)— insert— ‘Maximum penalty—20 penalty units.’. ˙ Amendment of s 7 (Lighting of fires) 7.(1) Section 7, ‘within the Recreation Area’— omit, insert— ‘in a recreation area’.

(3) Section 7(2)‚ ‘Subject to by-law 6, a’— omit, insert— ‘A’. (4) Section 7(4), ‘Except as provided in clause 2(b) a’— omit, insert— ‘A’. (5) Section 7(1), (2), (3) and (4)— insert— ‘Maximum penalty—20 penalty units.’. (6) Section 7(5), from ‘lit in the Recreation Area’ to ‘property of persons in the Recreation Area,’— omit, insert— ‘in a recreation area is, or may become, a hazard to the area, a person or property in the area,’. ˙ Amendment of s 8 (Water) 8.(1) Section 8, ‘the Recreation Area’— omit, insert— ‘a recreation area’. (2) Section 8— insert— ‘Maximum penalty—20 penalty units.’.
s 9 7 s 10 Recreation Areas Management (Fraser and No. 311, 1996 Moreton Islands) Amendment (No. 1) ˙ Replacement of s 9 (Firearms, explosives, traps, etc.) 9.(1) Section 9— omit, insert— ˙ ‘ Firearms, explosives, traps etc. ‘ 9.(1) A person must not possess or use any of the following in a recreation area without the board’s written approval— (a) a bow, catapult or weapon; (b) an explosive device; (c) a trap, snare or net. Maximum penalty—20 penalty units. ‘ (2) A person must not carry a loaded spear gun or discharge a spear gun, unless the person is in tidal waters where spear fishing is allowed under an Act. 2 Maximum penalty—20 penalty units. 3 ’. ˙ Amendment of s 10 (Litter) 10.(1) Section 10, ‘the Recreation Area’— omit, insert— ‘a recreation area’. (2) Section 10(3)— insert— ‘Maximum penalty—20 penalty units.’. 2 For where spear fishing is not allowed, see the Fisheries Regulation 1995 , schedule 3, part 5. 3 If a recreation area includes an area that is a protected area under the NatureConservation Act 1992 , the use of the things mentioned in section 9 is subject to that Act.
s 11 8 s 13 Recreation Areas Management (Fraser and No. 311, 1996 Moreton Islands) Amendment (No. 1) ˙ Amendment of s 11 (Behaviour) 11.(1) Section 11(b)— omit. (2) Section 11, ‘the Recreation Area’— omit, insert— ‘a recreation area’. (3) Section 11— insert— ‘Maximum penalty—20 penalty units. ‘ (2) Subsection (1)(g) does not apply to the Inskip Peninsula recreation area.’. ˙ Replacement of s 12 (Movement of objects) 12. Section 12— omit, insert— ˙ ‘ Movement of objects ‘ 12. A person must not throw, roll or discharge an object in a recreation area so as to cause— (a) danger or fear to another person; or (b) damage to another person or to property. Maximum penalty—20 penalty units.’. ˙ Amendment of s 13 (Limited access areas) 13.(1) Section 13, ‘the Recreation Area’— omit, insert— ‘a recreation area’.

(3) Section 13(2)— omit, insert— ‘ (2) A person must comply with a notice erected under subsection (1). Maximum penalty—20 penalty units.’. ˙ Amendment of s 14 (Plants) 14.(1) Section 14, ‘the Recreation Area’— omit, insert— ‘a recreation area’. (2) Section 14— insert— ‘Maximum penalty—20 penalty units.’. ˙ Amendment of s 15 (Animals) 15.(1) Section 15, ‘the Recreation Area’— omit, insert— ‘a recreation area’. (2) Section 15— insert— ‘Maximum penalty—20 penalty units. ‘ (2) Subsection (1) does not apply to dogs in the Inskip Peninsula recreation area.’.
s 16 10 s 18 Recreation Areas Management (Fraser and No. 311, 1996 Moreton Islands) Amendment (No. 1) ˙ Amendment of s 16 (Public entertainment, etc.) 16.(1) Section 16, ‘the Recreation Area’— omit, insert— ‘a recreation area’. (2) Section 16— insert— ‘Maximum penalty—20 penalty units.’. ˙ Amendment of s 17 (Vehicles) 17.(1) Section 17(1)(a)— omit, insert— ‘(a) the person is licensed to drive or ride the vehicle under a transport law; and’. (2) Section 17(1)(b), ‘the Main Roads Act 1920-1990 ’— omit, insert— ‘a transport law’. (3) Section 17, ‘the Recreation Area’— omit, insert— ‘a recreation area’. (4) Section 17(6)— insert— ‘Maximum penalty—20 penalty units.’. ˙ Amendment of s 18 (Vessels) 18.(1) Section 18, ‘the Recreation Area’— omit, insert— ‘a recreation area’.
s 19 11 s 21 Recreation Areas Management (Fraser and No. 311, 1996 Moreton Islands) Amendment (No. 1) (2) Section 18— insert— ‘Maximum penalty—20 penalty units.’. ˙ Amendment of s 19 (Aircraft, hovercraft, etc.) 19.(1) Section 19, ‘the Recreation Area’— omit, insert— ‘a recreation area’. (2) Section 19(2)— insert— ‘Maximum penalty—20 penalty units.’. ˙ Amendment of s 20 (Directions of authorized officer) 20.(1) Section 20, ‘the Recreation Area’— omit, insert— ‘a recreation area’. (2) Section 20 — insert— ‘ (4) A person must comply with a direction given to the person, unless the person has a reasonable excuse for not complying with it. Maximum penalty—20 penalty units.’. ˙ Amendment of s 21 (Notices) 21.(1) Section 21(1)— insert— ‘Maximum penalty—20 penalty units.’.
s 22 12 s 24 Recreation Areas Management (Fraser and No. 311, 1996 Moreton Islands) Amendment (No. 1) (2) Section 21— insert— ‘ (3) This section does not apply to an official traffic sign within the meaning of the Traffic Act 1949. ’. ˙ Replacement of s 22 (Prescribed infringements) 22. Section 22— omit, insert— ˙ ‘ Prescribed infringements ‘ 22.(1) Offences against sections 4 to 21 are prescribed infringements for section 28 of the Act, definition “prescribed infringement”. 4 ‘ (2) The penalty payable under an infringement notice for a prescribed infringement for each of the following provisions of this by-law is the penalty set out opposite the provision— (a) section 7(2)(a) and (b)—$60; (b) section 10(3)(c)—$70; (c) sections 4(1), 5(1) to (3), 6(2), 7(1), (3) and (4), 8, 9(1) and (2), 10(1) to (3)(b), 11(1), 12, 13(2), 14, 15(1), 16, 17(1) to (6), 18, 19(1) and (2), 20(4) and 21(1)—$50.’. ˙ Omission of s 23 (General offence provision) 23. Section 23— omit. ˙ Repeal 24. The Moreton Island Recreation Area By-law 1991 is repealed. 4 Section 28 of the Act (Interpretation)
