Citation

1. These regulations may be cited as the Recognized Hospitals and Incorporated Health Centres (Compensable and Non-Medicare Patients) Fees Regulations, 1989.

Revocation of part of existing regulations

2. Regulation 9 of the Recognized Hospitals and Incorporated Health Centres Compensable Patients Charges Regulations, 1981 (see Gazette, 27 August, 1981, p. 705) and the seventh schedule to those regulations are revoked.

Later revocation of remainder of existing regulations

3. (1) The remaining provisions of the Recognized Hospitals and Incorporated Health Centres Compensable Patients Charges Regulations, 1981, are revoked.

(2) This regulation will come into operation on 1 March, 1989.

Commencement

4. (1) Subject to regulation 3 and this regulation, these regulations will come into operation on 1 February, 1989.

(2) Clauses 1 to 6 (inclusive) and 8 of the schedule will come into operation on

1 March, 1989.

Interpretation

5. In these regulations—

"compensable patient" means a person receiving services from a recognized hospital or incorporated health centre who is, or may be, entitled to payment, or has received payment, by way of compensation in respect of the injury, illness or disease for which the patient is receiving services:

"in-patient" means a person who is admitted as a patient of a recognized hospital or incorporated health centre and is not discharged until a day subsequent to the day of admission:

"long stay in-patient" means an in-patient who is certified by a legally qualified medical

practitioner as a patient who is unlikely to recover sufficiently to be discharged:

"Medicare patient" means a patient who is an eligible person for the purposes of receiving

medical benefits under the Health Insurance Act 1973 of the Commonwealth:

"prescription item" means—

(a)

a pharmaceutical or other item supplied on the prescription of a medical practitioner, dentist or other person authorized to prescribe the item;

or

(b)

an ancillary item required for the administration of such pharmaceutical or other item:

"private patient" means a patient of a recognized hospital or incorporated health centre who

receives medical or diagnostic services from a medical practitioner selected by the patient:

"same day patient" means a person who is admitted as a patient of a recognized hospital or

incorporated health centre and is discharged on the day of admission:

"teaching hospital" means—

(a)

Royal Adelaide Hospital;

(b)

The Queen Elizabeth Hospital Inc.;

(c)

Flinders Medical Centre;

(d)

Modbury Hospital;

(e)

Adelaide Medical Centre for Women and Children;

(f)

Lyell McEwin Health Service.

Fees to be charged

6. (1) The fee to be charged by a recognized hospital or incorporated health centre for a service of a kind set out in the schedule (other than in clause 7) provided to a compensable patient or to a patient who is not a Medicare patient is as set out in the schedule.

(2) The maximum fee that a recognized hospital or incorporated health centre may charge for a service of a kind referred to in clause 7 of the schedule provided to a compensable patient or to a patient who is not a Medicare patient is as set out in that clause.

Remission of fees

7. A recognized hospital or incorporated health centre may remit the whole or part of a fee payable to it under these regulations in order to alleviate financial hardship.
