AN ORDINANCE

To amend the Real Property (Unit Titles) Ordinance 1970.

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Ordinance under

the Seat of Government (Administration) Act 1910-1973.

REAL PROPERTY (UNIT TITLES) ORDINANCE 1975

1. (1) This Ordinance may be cited as the Real Property (Unit

Titles) Ordinance 1975.*

(2) The Real Property (Unit Titles) Ordinance 1970,f as amended by this Ordinance, may be cited as the Real Property (Unit Titles)
Ordinance 1970-1975.

2 . This Ordinance shall come into operation on a date to be fixed by the Minister of State for the Capital Territory by notice published in the Gazette.

3. Section 4 of the Real Property (Unit Titles) Ordinance 1970 is

repealed.

4. Section 5 of the Real Property (Unit Titles) Ordinance 1970 is amended by omitting sub-section (1 ) and substituting the following sub-section:—

" (1) In this Ordinance—

' graphic bar scale ' means a set of marks on a plan, at measured distances on a line, which indicates the scale to which the plan is drawn;

' the Principal Ordinance ' means the Real Property

Ordinance 1925-1972.".

5. The First Schedule to the Real Property (Unit Titles) Ordin­

ance 1970 is amended—

(a) by omitting from Form 1 the words " Scale: feet to the

inch " and substituting the words—
" Scale 1: [insert ratio]

[Insert graphic bar scale]"; and

(b) by omitting from Form 3 the words " Scale: feet to the

inch " and substituting the words—
" Scale 1: [insert ratio]

[Insert graphic bar scale]".

6. The Second Schedule to the Real Property (Unit Titles)

Ordinance 1970 is amended—

(a) by omitting paragraph 1 of Part I and substituting the following paragraph:—

" 1. One copy of each sheet containing a diagram or diagrams shall be of good quality tracing linen or other material approved by the Registrar and other copies and other sheets shall be of good quality paper or other material approved by the Registrar.";

(b) by omitting paragraph 6 of Part I and substituting the following paragraph:—

"6. The contents of a sheet shall be so placed as to leave a margin of at least 40 mm on the left-hand side of the sheet and a margin of at least 15 mm on each of the other three sides of the sheet.";

(c)

by omitting from paragraph 8 of Part I the words " linen or paper " and substituting the words " linen, paper or other material approved by the Registrar ";

(d)

by omitting from paragraph 2 of Part II the words " a stated scale, being ";

(e) by inserting after paragraph 2 of Part II the following

paragraph:— " 2A . The scale to which a diagram is drawn shall be expressed as a ratio combined with a graphic bar scale.";
and
(f) by omitting paragraph 4 of Part II and substituting the following paragraph:—
" 4. All linear measurements shall be shown in metres and decimal fractions of a metre.".

7. Notwithstanding the amendments effected by this Ordinance,

the Registrar shall register a units plan if—

(a)

the units plan is in a form that complies with the require­ ments of section 8 of the Real Property (Unit Titles) Ordinance 1970 as in force immediately before the date of commencement of this Ordinance; and

(b)

the documents referred to in sub-section 9 (1) of the Real Property (Unit Titles) Ordinance 1970 as in force immedi­ ately before the date of commencement of this Ordinance are lodged with the Registrar within the period referred to in that sub-section and before the expiration of the period of 6 months after the date of commencement of this Ordinance.
