Commencement Proclamation

under the

Real Property and Conveyancing Legislation Amendment Act
2009 No 17

TOM BATHURST, Administrator I, T. F. Bathurst, Administrator of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Real Property and Conveyancing Legislation Amendment Act 2009, do, by this my Proclamation, appoint 1 November 2011 as the day on which the uncommenced provisions of that Act commence.

Explanatory note

The object of this Proclamation is to commence provisions of the Real Property and

Conveyancing Legislation Amendment Act 2009 that:

(a)

introduce additional identification requirements to the Real Property Act 1900 in relation to mortgagees and witnesses, and

(b)

require a mortgagee or chargee of land to take reasonable care in exercising a power of sale in respect of mortgaged or charged land under the Conveyancing Act 1919.
