Explanatory note

The object of this Regulation is to amend the Real Property Regulation 2014 to remove specific references to the use of facsimiles as a means by which requisitions for official searches of the Register may be lodged. This Regulation is made under the Real Property Act 1900, including sections 96B, 96C, 96G and 144 (the general regulation-making power).

This Regulation is the Real Property Amendment (Official Searches) Regulation
2016.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Real Property Regulation 2014

(1) Clause 10 Official searches

Omit “, by facsimile” from clause 10 (3).

(2) Schedule 1 Fees
Omit “, facsimile” from item 32 of Schedule 1.
