An Ordinance to amend the Real Property Ordinance 1925

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

REAL PROPERTY ( A M E N D M E N T ) ORDINANCE 1979
1. This Ordinance may be cited as the Real Property (Amendment)

Ordinance 1979.'

2. In this Ordinance, "Principal Ordinance" means the Real Property Ordinance 1925. 2

3. This Ordinance shall come into operation on 1 July 1979.

4. Section 48 of the Principal Ordinance is amended by omitting from sub-section (4) " , and that instrument when so constructively embodied and stamped with the seal of the Registrar," and substituting " a n d " .

5. Section 139 of the Principal Ordinance is amended by omitting from sub-section (2) " and 6 " and substituting", 6, 7, 8, 9 and 10".

6. Section 168 of the Principal Ordinance is repealed and the follow­ ing sections are substituted:

" 168. Wherever a document is required, under this Ordinance, to be in accordance with a form in a schedule, a document that is in a form having a like effect to the form in the schedule and that is stamped with, or bears a representation of the imprint of, the seal of the Registrar shall

"168A. (1) A person shall not cause to be printed a document

bearing a representation of the imprint of the seal of the Registrar except

with the approval of the Registrar.

Penalty: $500.

" ( 2 ) An approval referred to in sub-section (1) shall be in writing and shall specify the contents of the document to which the approval re­ lates and the number of copies of the document that the person may print.".

7. Section 169 of the Principal Ordinance is amended by omitting

from sub-section (1) " e v e r y " and substituting "copies of each".

8. The Eighteenth Schedule to the Principal Ordinance is amended

by adding at the end thereof the following items:

"7 On lodging a request for an approval under section 168A—for each kind of
document to which the request relates 14
8 On lodging a request for the stamping of documents with the seal of the
Registrar—for each kind of document to which the request relates 14
9 For stamping documents with the seal of the Registrar in accordance with a request referred to in item 8—
(a) where the number of documents to which the request relates does
not exceed 100 3
(b) where the number of documents to which the request relates
exceeds 100—for each 100 documents or part of 100 documents . 3

10        For examining each instrument not stamped with the seal of the Registrar

and not bearing a representation of the imprint of that seal 14"
