AN ORDINANCE

To amend the Real Property Ordinance 1925-1942.

B E it ordained by the Administrator of the Government of Federal Executive Council, in pursuance of the powers conferred the Commonwealth of Australia, with the advice of the by the Seat of Government Acceptance Act 1909-1938 and the Scat
of Government (Administration) Act 1910-1947, as follows:—

1.— (1.) This Ordinance may be cited as the Real Property short title

Ordinance 1951. and citation.

(2.) The Real Properly Ordinance 1925-1942 is in this

Ordinance referred to as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordinance,

may be cited as the Real Property Ordinance 1925-1951.

2. Section one hundred and one of the Principal Ordinance is Discharge of

(a) by inserting in sub-section (1.), after the words " having thereon an endorsement", the words ", or accom- panied by a memorandum,"; and

(b) by inserting in sub-section (2.). after the word

" endorsement ", the words " or memorandum ".

3. Section one hundred and forty of the Principal Ordinance Fee upon

" (2.) Where a fee is payable under this Ordinance or the regulations thereunder by or on behalf of the Government of a country outside Australia or an international organization of which Australia is a member, the Attorney-General may, in his discretion, remit the payment of the fee or of portion of the fee.".

5. The Eighteenth Schedule to the Principal Ordinance IS Eighteenth

amended— Schedule-

(a) by omitting the word " first" (first occurring) ;

(b) by inserting after the item—

" Entering memorandum of varia-

tion of purposes of lease . . 0 .10 .0"

the item—

" Noting expiration of lease . . 0.10.0 " ; and

• Notified in the Commonwealth Gazette on 20th September, 1951.

(c) by omitting the words " re-entry by lessee " and insert

ing in their stead the words " re-entry by lessor ".
