No. 14 of 1934.

AN ORDINANCE

To amend the Real Property Ordinance 1925-1933.

BE it ordained by the Governor-General, in and over the Executive Council, pursuant to the powers conferred by the Seat

Commonwealth of Austral ia, with the advice of the Federa l

of Government Acceptance Act 1909, and the Seat of Government
(Administration) Act 1910-1933, as follows:—

1.— (1.) This Ordinance mav be cited as the Real Property short title

Ordinance 1934. and citation.
(2.) The Real Property Ordinance 1925-1933 is in this

Ordinance referred to as the Principal Ordinance.

(3.) The Pr incipal Ordinance, as amended by this Ordinance,

may be cited as the Real Property Ordinance 1925-1934.

2. After section one hundred and thirty-eight A of the
Principal Ordinance the following section is inserted in P a r t

XIV.  :—

" 138n. Any instrument by which an executor declares that he BagtotMtion holds as trustee or beneficiary, as the case may be, may be regis- by executor, tered by the Registrar of Titles upon payment of a fee of One

pound, and the Registrar of Titles shall, after such evidence is given as he requires, and after notice is given to such persons as he directs, enter, vary, or wi thdraw caveats, as the case requires, and make such entry in the Register Book as is proper in the circumstances.".
