REAL PROPERTY ACT 1900 – REGULATION

(Relating to fees for determining land boundaries)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Real Property Act 1900, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 April 1990.

Amendment

2. The Real Property Act Regulations 1970 are amended by

inserting in Schedule 3 after item 7 the following items:

7A. On lodgment of an application for the determination under Part 14A of the Act of the position of the common boundary of adjoining lands ............................................................ 100.00

7B.

On lodgment of a request under section 135J of the Act for referring a matter to the Land and Environment Court for determination of the position of a boundary of land ............................ 360.00

EXPLANATORY NOTE

The object of this Regulation is to prescribe the fees payable to the

Registrar-General concerning the determination of the boundary between adjoining
lands.
