REAL PROPERTY ACT 1900-REGULATION
(Relating to plans annexed to or endorsed on dealings or caveats)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Real Property Act 1900, has been pleased to make the Regulation set forth hereunder.

Commencement
| 1. This Regulation comences on 1 August | 1996. |
Amendment
| 2. The Real Property Regulation 1993 is | amended by omitting |
paragraph (3) (d) o f Schedule 4 and by inserting instead the following
subparagraph:
| (d) | sufficient information to define any proposed easement, or any proposed variation of an existing easement, and its relationship to the boundaries of any affected parcel; |
EXPLANATORY NOTE
Schedule 4 to the Real Property Regulation 1993 sets out the requirements for plans annexed to or endorsed on dealings or caveats. At present, paragraph (3) (d) or that Schedule requires information to be provided about proposed easements and their relationship to the boundaries of any affected parcel.
The object of this Regulation is to require information also to be provided about any
proposed variation of an easement.
This Regulation is made under the Real Property Act 1900, i n particular section 144 (the general regulation making power).
