REAL ESTATE SERVICES COUNCIL ACT 1990 - REGULATION
(Relating to the corporate functions
of the General Manager) NEW SOUTH WALES

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Real Estate Services Council Act 1990, has been pleased to make the Regulation set forth hereunder.

Citation
1. This Regulation may be cited as the Real Estate Services Council Regulation 1990.
Commencement
2. This Regulation commences on 15 June 1990.
Definition
3. In this Regulation, "the Act" means the Real Estate Services Council Act 1990.
Corporate functions of General Manager
4. (1) For the purposes of section 10 (1) (d) of the Act, all of the functions of the Council relating to the following are prescribed as corporate functions of the General Manager.

(a)
applications for and objections to the grant of licences or the renewal of licences under section 23;
(b) complaints for the cancellation of licences under section 29;
(c)
complaints for the disqualification of former licensees under section 29A;
(d) appeals under section 31;
(e)
authorising officers of the Council for the purposes of section 38B;
(f)
granting applications conditionally or unconditionally, refusing applications or imposing other conditions on applications under section 39AA;
(g) appeals under section 39AA;
(h) applications for registration of real estate dealers and objections to applications for registration of real estate dealers under sections 51A and 51B; (i) complaints for the cancellation of registration of real estate dealers under section 51C;
(j)
complaints for the disqualification of former real estate dealers under section 51D;
(k)
appeals under section 51E from determinations under sections 51A, 51C and 51D;
(l)
applications for approvals or for the removal or variation of conditions imposed on approvals and appeals under section 52A;
(m)
applications for registration or renewal of registration of real estate salesmen, trainee auctioneers, business salesmen, stock and station salesmen or trainee stock buying agents under section 57;
(n)
complaints for cancellation of certificates of registration under section 60;
(o)
appeals under section 61 in respect of determinations under section 57 or 60.
(2) In subclause (1), references to sections are references to sections
of the Auctioners and Agents Act 1941.

EXPLANATORY NOTE
The object of this Regulation is to specify certain functions of the Real Estate Services Council under the Auctioneers and Agents Act that may be exercised or performed only by the General Manager of the Council.
