RE AL ESTATE SERVICES COUNCIL ACT 1990— REGULATION

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Real Estate Services Council Act 1990, has beenpleased to make the Regulation set forth hereunder.

Citation
1. This Regulation may be cited as the Real Estate Services Council
Regulation 1995.
Commencement
2. This Regulation commences on 1 September 1995.
Definitions
3. In this Regulation:
“the associated Act” means the Property, Stock and Business Agents
Act 1941;
“the principal Act” means the Real Estate Services Council Act
1990.
Corporate functions of General Manager
4. For the purposes of section 10 (1) (d) of he principal Act, the functions of the Council relating to the following matters are prescribed as corporate functions of the General Manager:
(a)
receiving applications for and objections to the grant of licences or the renewal of licences under section 23 of the associated Act;

| (b) | making complaints for the cancellation of licences under section 29 of the associated Act; |
| (c) | making complaints for the disqualification of former licensees under section 29A of the associated Act; |
(d) acting as a party in appeals under section 3 1 of the associated Act;
| (e) | authorising officers of the Council for the purposes of section 38B of the associated Act; |
| (f) | granting applications conditionally or unconditionally, refusing applications or imposing other conditions on applications under section 39AA of the associated Act; |
| (g) | acting as a party in appeals under section 39AA of the associated Act; |
| (h) | receiving applications for and objections to registration or renewal of registration under section 57 of the associated Act; |
(i) making complaints for the cancellation of certificates of registration under section 60 of the associated Act;
(j)
making complaints for the disqualification of former holders of certificates of registration under section 60AA of the associated Act;
(k) acting as a party in appeals under section 61 of the associated Act.
Repeal
5. The Real Estate Services Council Regulation 1990 is repealed.

EXPLANATORY NOTE
The object of this Regulation is to repeal and remake, without any changes in substance, the provisions of the Real Estate Services Regulation 1990. The new Regulation prescribes certain functions exercisable by the Real Estate Services Council under the Property, Stock and Business Agents Act 1941 as being the corporate
functions of the General Manager of that Council.

This Regulation is made under the Real Estate Services Council Act 1990, including
section 23 (the general regulation making power) and section 10.
This Regulation comprises or relates to matters of a machinery nature.
This Regulation i s made in connection with the staged repeal of subordinate
legislation under the Subordinate Legislation Act 1989.
