DECISION

Fair Work (Registered Organisations) Act 2009
s.159—Alteration of other rules of organisation

Real Estate Employers' Federation of South Australia and the Northern

Territory

(R2015/179)

MR ENRIGHT MELBOURNE, 2 NOVEMBER 2015
Alteration of other rules of organisation.

[1]        On 10 August 2015 the Real Estate Employers' Federation of South Australia and the

Northern Territory (the organisation) lodged with the Fair Work Commission a notice and

declaration setting out particulars of alterations to the rules of the organisation.

[2]        The particulars set out alterations to rules 4.7 and 4.13 of the rules of the

organisation. The alterations include, among other things, changes enabling members’

subscriptions to be handled by email to organisation’s website; subscriptions to be paid by

credit/debit card; alterations providing that a member shall not be financial if the

subscription has not been paid within three months of the date of issue or pay instalment

date; and changes concerning the suspension of non-financial members, including the

provision of a right of reply before the Board makes a decision regarding the suspension or

removal of a member of the Association.

[3]        On the information contained in the notice, I am satisfied the alterations have been

made under the rules of the organisation.
[2015] FWCD 7559

[4]        In my opinion, the alterations comply with and are not contrary to the Fair Work

(Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise

agreements, and are not otherwise contrary to law. I certify accordingly under subsection

159(1) of the Fair Work (Registered Organisations) Act 2009.
