REAL ESTATE AND BUSINESS AGENTS SUPERVISORY BOARD

(ELECTIONS) AMENDMENT REGULATIONS 1996

Made by His Excellency the Governor in Executive Council.

Citation

1. These regulations may be cited as the Real Estate and Business Agents

Supervisory Board (Elections) Amendment Regulations 1996.

Principal regulations

2. In these regulations the Real Estate and Business Agents Supervisory Board (Elections) Regulations 1980* are referred to as the principal regulations.

Regulations 4A and 4B inserted

3.    After regulation 4 of the principal regulations the following regulations

are inserted -

Candidates details with ballot papers

4A. (1) On or before the day and time appointed under regulation 4 for a particular election, each nominated candidate

may contact the returning officer with a brief summary of that candidate's biographical details (not exceeding 300 words in length) to be sent to the voters along with the ballot paper.

Regulation 5 amended

4.     Regulation 5 (1) of the principal regulations is amended -

(a) by inserting after "shall" the following -
if an election is required, ";
(b) by deleting "so as to reach him not later than seven days prior to" and substituting the following -

(c) by deleting "twenty-one days prior to that day" and substituting the following -

Regulation 6 amended

5.    Regulation 6 of the principal regulations is amended -

(a) in subregulation (2) -
(i) in paragraph (a), by deleting "or signed by the Returning Officeror by a person authorised in that behalf by the

(ii) by deleting paragraph (b) and substituting the following paragraph -

7.    Regulations 9 and 10 of the principal regulations are repealed and the

following regulations are substituted -

9. (1) Where, on application before the time of the close of the ballot in an election, the returning officer is satisfied that a ballot

(a) if the voter's declaration is found to be in order, mark

the roll; or

(b) if the voter's declaration is not in order, mark the

envelope with the word "rejected" and set the envelope aside for safe keeping.

Regulation 11 amended

8.    Regulation 11 of the principal regulations is amended -

by inserting after the regulation designation "11." the

(a) subregulation designation "(1)";
(b) by deleting "A ballot" and substituting the following -

The returning officer and any other officers assisting the returning officer are entitled to such remuneration as is determined by the Electoral Commissioner.

All costs, charges and expenses incurred by the returning

officer in connection with the election are to be reimbursed by the
Board from the moneys described in section 7 (7) of the Act.

Appendix amended

11. The Appendix to the principal regulations is amended by deleting

Forms 2, 3 and 4 and substituting the following forms -
