AGENTS AMENDMENT ACT

No. 18 of 1988

AN ACT to amend the Real Estate and Business Agents Act 1978.

[Assented to 9 September 1988)

The Parliament of Western Australia enacts as follows:

Short title

1. This Act may be cited as the Real Estate and Business Agents.

Amendment Act 1988.

Commencement

2. This Act shall come into operation on such day as is fixed by

proclamation.

Principal Act

3. In this Act the Real Estate and Business Agents Act 1978* is

referred to as the principal Act.

Section 130 amended

4. Section 130 of the principal Act is amended in subsection (1)-

(a) by deleting paragraph (a) and substituting the following paragraph-

" (a) first, in payment of the costs and expenses (including

audit costs) of administering the Trust; "; and

(b) by deleting subparagraph (iii) of paragraph (b) and substituting the following subparagraph-

" (iii) of or towards such costs and expenses incurred for the purposes of educating persons who are licensed or registered under this Act or are concerned in the administration of this Act, or the public generally, as are prescribed or of a prescribed kind. ".

Section 145 amended

5. Section 145 of the principal Act is amended in subsection (2) by

deleting paragraph (h) and substituting the following paragraph-

" (h) prescribe the costs and expenses, or kinds of costs and expenses, to which part of the moneys accruing to the credit of the Trust Interest Account shall be applied in accordance with section 130; ".
