Decision

1. At the Hearing before the Commission on 1 March 2017, the Commission granted this Application made by the Queensland Nurses' Union of Employees seeking to amend the name of the said organisation.

2. The Application was filed in the Industrial Registry on 20 January 2017. At that time, the Application was made in accordance with s 473 in the Industrial Relations Act 1999 and s 18 of the Industrial Relations Regulation 2011.   

3. At the date of hearing before the Commission on 1 March 2017, the Industrial Relations Act 2016 (the Act) came into effect and by way of the transitional provisions at s 1044, the Commission made its decision pursuant to the relevant provisions of s 661 of the Act.

4. The Applicant is an industrial organisation of employees registered under the Act.

1. The object of the amendment is to amend the name of the organisation from "Queensland Nurses' Union of Employees" to "Queensland Nurses and Midwives' Union of Employees".

1. On the material before the Commission, I am satisfied that in accordance with s 661 of the Act, the amendment to the name has been proposed under the organisation's rules; is not the same as another organisation's name; or so similar to another organisation's name as to be likely to cause confusion.

1. I am further satisfied that the Applicant has complied with the requirements contained within in r 197 of the Industrial Relations (Tribunals) Rules 2011 and s 18 of the Industrial Relations Regulation 2011.

1. Accordingly, I grant approval for the amendment to the name of the organisation, as sought in the Application filed in the Industrial Registry on 20 January 2017.

2. The operative date of the amendment will be 1 March 2017.

1. I make the following orders:

1.The Commission approves, pursuant to s 661 of the Industrial Relations Act 2016, an amendment to the name of the organisation from "Queensland Nurses' Union of Employees" to "Queensland Nurses and Midwives' Union of Employees".
