HER HONOUR:   On 19 January 2017, Ms McEwen filed and served, first, a document titled “Supporting facts relied upon by Ms McEwen” which I will refer to as “Supporting Facts List” and, second, a volume titled “Anne McEwen Supplementary Tender Bundle for Gordon J hearing”, which I will “define as the “Supplementary Bundle””.  Ms McEwen is refused leave to rely upon the “Supporting Facts List” and the “Supplementary Bundle” at the hearing of the trial commencing on Monday, 23 January 2017.  I publish my ruling.
