The debtor is justly and truly indebted

to me in the

sum of $1,991.62 being the

balance due under the final judgment recovered in the District Court of New South Wales on

the 6th day

of May 1975 ($1,859.24) for income

tax and additional tax for late payment and

$132.38 interest thereon to 2nd January 1976".

The return date of the petition was 23 September 1976.

On 31 August the applicant obtained from

an

assistant registrar of the District Court an order (pursuant to

s.88 of the District Court Act 1973) "that the unpaid amount

of

the judgment

debt be paid by instalments

of $100 per month, the

first such payment to be made on or before

2 8 September 1976".

A sequestration order was made against the estate

of the bankrupt

on 23 September. It is common ground that,at that

time, the order for payment by instalments was in force. The

first submission on behalf

o the bankrupt is that therefore the

!

sequestration order ought not to have been made and the court

should accordingly pursuant to

S. 154(1) (a) of the Bankruptcy Act

1966 annul the bankruptcy, because when the sequestration order was made the debt on which the petitioning creditor relied was

not, within

the meaning of

S. 44(1) (b) (ii) of the Act, "payable

either immediately or at a certain future time".

Under the District Court Act the judgment creditor

may apply for leave to pay the judgment

debt, or the balance of it

then owing to the judgment creditor, by such instalments payable

at such times as may be specified in the application: s.88(1) (a);

and the registrar may order that the judgment debt be paid by

such instalments payable

at such times as are specified

ir. the

application: S. 88(4)(a)(i).

No question was raised as to the

validity of the order here that payment

of the unpaid balance

(then amounting to $1,991.62) of the jud3ment debt be made

by

monthly instalments of $100.
