Act No. 13, 1909.

An Act to provide for the closing of certain

level-crossings on the Government Railways,

and the substitution therefor of bridges, subways, and other works ; to declare certain portions of such bridges, subways, and works to be public thoroughfares ; and for purposes consequent thereon or incidental thereto.

Assembly of New South Wales in Parl iament assembled, and by the the advice and consent of the Legislat ive Council and Legislat ive authority of the same, as follows:—

BE it enacted by the King's Most Excellent Majesty, by and with

1. This Act may be cited as the " Ra i lways Crossings Act,

1000."

2. The Chief Commissioner for Ra i lways and Tramways may close the several level-crossings over the Government Ra i lways described in the first column of the Schedule to this Act.

On and after the publication in the Gazette of a notification

by the said Chief Commissioner that any such level-crossing is closed
under the authority of this Act, all rights-of-way on and over such

crossing shall be extinguished.

3 . In any case where, by the said Schedule, works are to be

constructed in substitution for a level-crossing, the said Chief Commissioner shall, before closing such level-crossing, provide and open for public traffic the bridge or subway and other works mentioned

in the second column of the said Schedule, and set opposite to the
description of the said level-crossing, with suitable curves, grades, and
connections with thoroughfares.

So much of the lands comprising such bridge, subway, and works as is not within the lines of the boundary fences of a Government

ra i lway is hereby declared to be a public thoroughfare.
