245 ( tt££t Blatt t ANNO TERTIO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 25 of 1964 An Act to Amend "The Railways Acts, 1914 to 1963," in certain particulars [ASSENTED TO 9TH APRIL, 1964] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title . This Act may be cited as " The Railways Acts Amendment Act of 1964." (2) Principal Act. " The Railways Acts, 1914 to 1963 " are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as " The Railways Acts, 1914 to 1964." 2. Amendment of s. 5 . Section five of the Principal Act is amended by inserting after the definition " Employee " the following definition- " " General Manager "-In respect of a Division of the Railways, the officer appointed from time to time by the Commissioner to have charge of that Division;". 3. Amendment of s. 20 (2). Subsection (2) of section twenty of the Principal Act is amended by omitting the second paragraph and inserting in its stead the following paragraph- " But no such appointment shall be made unless the Commissioner has previously obtained the sanction of the Governor in Council to such appointment."
246 Railways Acts Amendment Act of 1964, No. 25 4. Amendment of s. 21 (5). Subsection (5) of section twenty-one of the Principal Act is amended by omitting the words " and the Commissioner's Goodwill Officers " and inserting in their stead the words " the Commissioner's Goodwill Officers and such other offices as may be determined from time to time by the Governor in Council (who is hereby authorised so to determine) by Order in Council published in the Gazette ". 5. Repeal of s. 25. The Principal Act is amended by repealing section twenty-five. 6. Amendment of s. 108 . Section one hundred and eight of the Principal Act is amended by adding the following subsection:- " (4.) Notwithstanding any other provision of this Act, the Commissioner may from time to time as he may consider necessary, fix charges other than prescribed charges for- ( a) the performance of special services; (b) the supply of particular classes of rollingstock for the carriage of goods or passengers; or (c) the carriage of goods the carriage of which at the prescribed charges would not result in a freight charge which, in his opinion, would be commensurate with the wagon space required for such carriage. Such charges shall be payable, be due and be recoverable in the same manner as prescribed charges." 7. Amendment of s. 123 . Section one hundred and twenty-three of the Principal Act is amended by omitting the words " ten pounds ", where firstly and secondly appearing, and inserting in their stead where omitted twice the words " twenty-five pounds ".
