B E it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legis lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:— Short title 1. This Act may be cited as “ The Railways Acts a co n n d struction. Amendment Act of 1954,” and shall be read as one with *“ The Railways Acts, 1914 to 1953,” herein referred to as the Principal Act. ’ Collective The Principal Act and this Act may be collectively title. cited as “ The Railways Acts, 1914 to 1954.” New s. 42 a 2. Where there is on any land taken by plaunrdcshafosre the Commissioner a dwelling house or other building rtimhemeprroeovtovineg fwohricwhh, ipcrhecietdwenats totatkheen uosre ofofrthaantylainndcidfoernttahle ppuurrppoossee, mo& thec. nertslafrnodms, rineqtuhireesoptioniobne orfemthoeveCdomthmeriessfiroonmer, orthdeecmoosltisohfedtakanindg, that land will be reduced by removing that dwelling house or other building therefrom to some other land, then the Commissioner may, with the prior approval of the Governor in Council but without complying with any of the other provisions of this Act relating to the taking of land, purchase on behalf of the Crown, by private treaty or otherwise, some other land for the purpose of removing thereto that dwelling house or other building: Provided that the Commissioner shall not, pursuant to this section, purchase any piece or parcel of land exceeding thirty-two perches in area for the purpose of removing thereto any one dwelling house or other building unless in the opinion of the Governor in Council there are special circumstances, in which case the Governor in Council may approve of the Commissioner purchasing a greater area of land. * 5 G. 5 No. 24 and amending Acts.
RAILWAYS AND TRAMWAYS. 1954. Railways Acts Amendment Act. (2.) Additionally to causing a dwelling house or other building to be removed to land purchased under this section for that purpose, the Commissioner may cause that dwelling house or other building to be altered, added to, or repaired and, if he deems it necessary in the circumstances, such other improvements to be effected on that land as he thinks fit. (3.) When land purchased under this section by the Commissioner has been improved by the removal thereto of a dwelling house or other building and by the effecting thereon of other improvements, if any, the Commissioner shall, as soon as may be, sell that land as so improved and thereupon he may execute for and on behalf of the Crown any transfer or other instrument necessary for assuring title to the purchaser. ( 4 .) This section shall apply so as not to limit the power of the Commissioner—. (a) To take under this Act on behalf of the Crown land for dwelling houses or other buildings required for any of the purposes of this Act, or for any purpose incidental to any of the purposes of this Act; or ( b ) To use as he deems fit for any of the purposes of this Act, or for any purpose incidental to any of the purposes of this Act, any dwelling house or other building specified in subsection one of this section, and for enabling such a use, to remove the same from the land whereon it is situated to any other land used or 0 proposed to be used for any of the purposes of this Act, or for any purpose incidental to any of the purposes of this Act.” ‘ 329 REGISTRATION OF FIRMS.
