ANNUATION INVESTIGA· [ASSENTED TO 4TH OCTOBER, 1929.] BE TION BOARD ACT OF 1929. it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows;- Short title. 1. This Act may be cited as "The Railway Super- annuation Investigation Board Act of 1929." Governor in 2. (1.) For the purpose of making inquiry and a C p ou p n o ~ m iltmay investigation into the matter of Railw . ay superannuation, Board. and for the purpose' of the formulatIOn of a scheme of railway superannuation, a Railway Superannuation Investigation Board is hereby established. Number of (2.) The Board shall consist of three members, who members. shall be appointed by the Governor in Council for a term not exceeding two years. Vacancies. (3.) If at any time a vacancy in the Board is caused by death, resignation, or otherwise of a member thereof, the Governor in Council shall appoint some suitable person to such vacancy. . Employers' (4.) In the appointment of members to the Board, aemndployees' regard shall be had to the interests of the Commissioner representa. for Railways and the State generally, and regard shall tives. be had to the interests of the employees of the said Commissioner. Chairman. (5.) The Governor in Council shall appoint one of such members to be chairman of the Board. Functions of 3. (1.) It shall be the duty of the Board and it is the ~ oard. hereby empowered to inquire into and collect data and to report to and place before the Governor in Council such scheme of superannuation in respect of officers of the Railway service to which the Board may, pursuant to its inquiries, consider it desirable that legislative sanction should be given. ~ oard to (2.) All expenses and fees (if any) incurred by Expensei'< of the Board 0'[' approved by the Governor in Council Board. under or in pursuance of this Act shall be p<1id out of the Consolidated Revenue Fund, which is hereby appropriated for that purpose. (2.) The members of the Board may, if the Governor in Council thinks fit, receive a fee for the services performed by them in respect of this Act. Moreover, the Board may engage the services of an actuary to assist the members in their deliberations, and such actuary shall be paid such fee therefor as may be approved by the Governor in Council. 5. The Governor in Council, on receipt of such Action of . report from t he B oard, may I.n.Its a bsoIutde ' Iscretl.On GCoouvnecrniloorn In approve of the scheme of superannuation as aforesaid receipt of or may refer same back to the Board for further inquiry ~ ~ h~ : ! e~ nd and amendment. Such scheme shall, inter alia, fix rates of contribu- tions, which rates may vary in respect of the class or classes of occupation concerned and the amount of any annuity or assurance payable under the said scheme. If, however, the Governor in Council approves of such scheme with or without amendment as aforesaid, he may, in his absolute discretion, cither- (i.) Introduce legislation embracing such scheme so approved; or (ii.) By Order in Council issued under this Act, promulgate and bring into force such approved scheme, to take effect as from a date to be fixed in such Order in CounciL 6. Any Order in Council issued under this Act, Order~ in promulgating and bringing into force any approved CounCIl. scheme of compensation in respect of railway employees, and whether such scheme provides for compulsory superannuation or voluntary superannuation, or both, shall have the same force and effect as if it had been actually enacted in and formed part of this Act, and shall be judicially noticed, and shall not be questioned in any proceedings whatever. * 1 Geo. The Governor in Council may from time to time make regulations providing for all or any purposes, whether general or to meet particular cases, that may be convenient for the administration oi this Act or that may be necessary or expedient to carry out the objects and purposes of this Act; and where there may be in this Act no provision or no sufficient provision in respect of any matter or thing necessary or expedient to give effect to this Act, providing for· and supplying such omission or insufficiency. Without limiting the generality of the foregoing provision, such regulations may be made for the purpose of regulating the business and procedure of the Board generally. Erefgfueclattoiofns. Parliament within fourteen sitting days after such publication, if Parliament is in session, and if not, then within fourteen days after the commencement of the next session.
