AN ACT to Authorise the Discontinuance of portion of the Tambellup-Ongerup Railway and to Revest in Her Majesty the land comprised therein.

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

1. This Act may be cited as the Railway (Portion Short title.

of Tambellup-Ongerup Railway) Discontinuance

and Land Revestment Act, 1963.

2. On the coming into operation of this Act

railway.

(a)

the railway described in the Schedule to this Act (in this Act called the "scheduled railway") shall cease to be operated on;

(b)

the material comprising the scheduled railway may be-

(i) used in the construction or main- tenance of any Government Railway according to the meaning given to that expression by section two of the Government Railways Act, 1904;

(ii)    used in the construction or main- tenance of any railway authorised to be constructed under any other Act, whether before or after the coming into operation of this Act; or

(iii)    sold, disposed of, or otherwise dealt with.

3. The costs of the scheduled railway as charged to the Government Railways Capital Account, may be omitted from the accounts prepared under Part IV of the Government Railways Act, 1904.

4. The land comprised in the scheduled railway is hereby revested in Her Majesty as of her former estate and is removed from the operation of the Transfer of Land Act, 1893.

Section 2.

SCHEDULE.

Description of Railway.

All that railway having a total length of seven chains and twenty links or thereabouts commencing at the south- western alignment of Whitehead Road and thence proceed- ing in an east by north-easterly direction and terminating at the south-western alignment of Yougenup Road both roads being in the townsite of Gnowangerup, which railway is portion of the railway constructed under the authority of the Tambellup-Ongerup Railway Act, 1911 (Act No. 11 of 1911).
