Railway Management Act (Repeal) Act 1997

An Act to repeal the Railway Management Act 1935 and to make certain consequential amendments to the Transport Act 1981 and the Police Offences Act 1935

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Railway Management Act (Repeal) Act 1997 . 2CommencementThis Act commences on a day to be proclaimed. 3Railway Management Act 1935 repealedThe Railway Management Act 1935 is repealed. 4Transport Act 1981 amendedThe Transport Act 1981 is amended as follows: (a) by omitting subsection (3) of section 5; (b) by omitting from section 5(4) "subsections (1) and (3)" and substituting "subsection (1)". 5Police Offences Act 1935 amendedThe Police Offences Act 1935 is amended by omitting from the definition of "public place" in section 3(1) "any railway station or railway platform or carriage, and any part of a railway as defined by the Railway Management Act 1935;" and substituting "any rail infrastructure, railway, or rolling stock, within the meaning of the Rail Safety Act 1997;". 6Regulations under Railway Management Act 1935 rescindedThe regulations made under the Railway Management Act 1935 and published in the Gazette on 5 March 1941 are rescinded. 7Administration of ActUntil provision is made in relation to this Act by order under section 4 of the Administrative Arrangements Act 1990  – (a) the administration of this Act is assigned to the Minister for Transport; and (b) the Department responsible to the Minister for Transport in relation to the administration of this Act is the Department of Transport.
