PreaniWe. TATHEEEAS ail Act was passed in the seventeenth year of tlie

reign of Her present Majesty intituled “ A n Act for regulating the Gauge o f Itaihcags” And whereas under the authority of another Act passed in the eighteenth year of Her said Majesty’s reign and numbered forty it is intended that all Railways wdthin the Colony shall he constructed only by the Government And whereas it is con­ sidered inexpedient to continue the restrictions created by the said first recited Act in respect of the Gauge on which such Railways shall he constructed Be it therefore enacted by His Excellency the Governor of New South Wales by and with the advice and consent of the Legislative Council thereof as follows :—

17 Vic. No. 11	The said first above recited Act shall be and the same is hereliy repealed except in so far as the same operated as a repeal of a certain other Act ivliich had before then been passed for the purpose of regulating the Gauge of Railways.
