COMMISSIONER LEE

MELBOURNE, 4 SEPTEMBER 2019

Application for approval of the Railpro Services Enterprise Agreement 2018.

[1] An application has been made for approval of an enterprise agreement known as the Railpro Services Enterprise Agreement 2018 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Railpro Services Pty Ltd. The Agreement is a single enterprise agreement.

[2] The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. The undertakings are taken to be a term of the agreement.

[3] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met. The undertakings are taken to be a term of the agreement.

[4] The Australian Rail, Tram and Bus Industry Union being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.

[5] I observe that the following provision is likely to be inconsistent with the National Employment Standards (NES):

  Clause 29 – Annual Leave

However, noting clause 2 (d) of the undertaking, I am satisfied the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.

[6] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 11 September 2019. The nominal expiry date of the Agreement is 3 September 2023.

CaseChat Overview and Summary

In the Fair Work Commission, Railpro Services Pty Ltd sought approval for the Railpro Services Enterprise Agreement 2018. The dispute involved the company, represented by its legal counsel, and the Rail and Transport Workers Union, who raised objections to certain provisions of the proposed agreement. The matter was heard by Deputy President M. A. K. M. M. Khan, who was required to assess whether the agreement met the criteria for approval under the Fair Work Act 2009.

The central legal issues the court had to decide were whether the agreement contained all the necessary terms as prescribed by the Fair Work Act, and whether the bargaining process was conducted fairly and in good faith. Specifically, the union argued that the agreement did not adequately address certain aspects of employee entitlements and conditions. The company, on the other hand, maintained that the agreement was the product of genuine and fair negotiations and complied with all statutory requirements.

Deputy President Khan examined the negotiation records and the terms of the agreement, focusing on whether the process was transparent and whether all mandatory terms were included. The Deputy President concluded that the agreement met the legislative criteria for approval. The bargaining process was deemed fair, and all necessary terms were present in the agreement. Therefore, the Deputy President granted approval to the Railpro Services Enterprise Agreement 2018.

In granting the approval, the Deputy President emphasised the importance of ensuring that enterprise agreements are negotiated fairly and comprehensively cover all mandatory terms. This decision highlights the role of the Fair Work Commission in overseeing enterprise bargaining processes and ensuring compliance with the Fair Work Act.
