Rail Safety National Law (WA) Amendment

Regulations 2017

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Rail Safety National Law (WA)

26 May 2017 GOVERNMENT GAZETTE, WA 2635

2.            Commencement

These regulations come into operation as follows -

(a)	regulations 1 and 2 - on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations - on 1 July 2017.

3.            Regulations amended

These regulations amend the Rail Safety National Law (WA)
Regulations 2015.

4.            Regulation 56 amended

(1) In regulation 56(1):

(a) delete "The following returns of information are required under section 120(3) (Power of Regulator to obtain information from rail transport operators) of the Law -" and insert:

For the purposes of section 120(3) (Power of Regulator to obtain information from rail transport operators) of the Law, a rail transport operator must provide the Regulator with a monthly return that sets out the following information -

(b) in paragraph (a) delete "a monthly return that sets Out in respect" and insert:

in respect of the whole

(c) in paragraph (a)(iii)(E) delete "control; and" and insert:

control;

(d)	after paragraph (a) insert: and
(e)	delete paragraph (b) and insert:

(b) as on the last working day of the month - the

number of employees of the rail transport
operator engaged to undertake rail safety work
in respect of a railway over which the operator

has effective management and control.

(2) In regulation 56(2) before "return," insert:

monthly

(3)	In regulation 56(3) delete "by subregulation (1)(a)" and insert:
under subregulation (1)
(4)	Delete regulation 56(4).

5.            Schedule 3 amended

In Schedule 3 Division 2 clause 1 in the Table:

(a) delete "96.86" and insert:

90.96

(b) delete "0.052" and insert:

0.045
