Rail Safety National Law (South Australia) (Rail Safety Work) Amendment Act 2020

An Act to amend the Rail Safety National Law (South Australia) Act 2012.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Rail Safety National Law (South Australia) (Rail Safety Work) Amendment Act 2020.

2Commencement

This Act comes into operation on a day to be fixed by proclamation.

3Amendment provisions

In this Act, a provision in Part 2 amends the Rail Safety National Law set out in the Schedule to the Rail Safety National Law (South Australia) Act 2012.

Part 2Amendment of Rail Safety National Law4Amendment of section 4 – Interpretation

Section 4(1), definition of rail infrastructure—after "operate" insert:

5Amendment of section 8 – Meaning of rail safety work
  1. (1)

    Section 8(1)(d)—before "maintaining" insert:

    constructing,

  2. (2)

    Section 8(1)(d)(ii)—after "infrastructure" insert:

    , including checking that the rail infrastructure is working properly before being used

  3. (3)

    Section 8(1)(f)—delete paragraph (f) and substitute:

    1. (f)

      work on or about rail infrastructure or associated works or equipment that places, or may place, the person performing the work at risk of exposure to moving rolling stock;
