Rail Safety Amendment Regulations

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Rail Safety Amendment Regulations
(No. 2) 2011.

2.            Commencement

These regulations come into operation as follows —

3.            Regulations amended

Fhese regulations amend the Rail Safety Regulations 2011.

4.            Regulation 21 amended

(1) In regulation 21 delete the definition of breath analysing
equipment and insert:

breath analysing equipment means apparatus of a type
approved for the purpose of the definition of breath
analysing equipment in the Road Traffic Act 1974

section 65;

(2)	In regulation 21 in the definition of authorised breath tester after "to operate" insert:
all types of
5.	Regulation 23 deleted Delete regulation 23.

6.           Regulation 27 amended

In regulation 27 delete "may be destroyed by or at the direction of a drug analyst not less that 6 months after the day on which it was taken." and insert:

must be destroyed by or at the direction of the analyst or drugs analyst immediately after the analyst or drugs analyst signs the certificate under regulation 26(5).
