RAIL SAFETY ACT 1993 No 50—PROCLAMATION

(L.S.) GORDON SAMUELS, Governor.

I, the Honourable Gordon Samuels, AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Rail Safety Act 1993, do, by this my Proclamation, appoint 1 March 1997 as the day on which section 28 of that Act commences.

EXPLANATORY NOTE

The object of this proclamation is to commence an uncommenced section of the Rail Safety Act 1993 that provides that the owner or operator of a railway who employs, or enters into a contract with, a person to perform railway safety work is guilty of an offence unless the person holds an appropriate certificate of competency under that Act. Railway safety work includes work carried out by a railway employee as a train driver, guard or engineman as a station-master, operator of train signals or shunter of trains or

connected with the repair, maintenance or upgrading of railway tracks or rolling stock.

This proclamation is made under section 2 of the Act.
