Application for approval of the Lake Imaging Enterprise Agreement (Imaging Staff - Geelong) 2022

  1. An application has been made for approval of an enterprise agreement known as the Lake Imaging Enterprise Agreement (Imaging Staff - Geelong) 2022 (Agreement). The application was made pursuant to section 185 of the Fair Work Act 2009 (Act). The Agreement is a single enterprise agreement.

  1. The application contained a copy of the Agreement to be lodged for approval. The application contained an error, in that a previous version of the Agreement was mistakenly lodged. On 10 August 2022, after the issue was raised by the Health Services Union, the Applicant filed the correct version of the Agreement which the employees had voted on. I am satisfied that the amendment to the application should be made and that it is appropriate to do so pursuant to section 586 of the Act.

  1. I am satisfied that each of the requirements of sections 186, 187 and 188 as are relevant to this application for approval have been met.

  1. The Health Services Union, being a bargaining representative for the Agreement, has given notice under section 183 of the Act that it wants the Agreement to cover it. In accordance with subsection 201(2) of the Act, I note that the Agreement covers the organisation.

  2. The Agreement is approved and, in accordance with section 54 of the Act, will operate from 22 August 2022. The nominal expiry date of the Agreement is 14 August 2025.
