I, HELEN LLOYD COONAN, Minister for Communications, Information Technology and the Arts, acting under subsection 33(3) of the Acts Interpretation Act 1901 and section 153J of the Radiocommunications Act 1992, and being satisfied that there are special circumstances justifying doing so, vary the Radiocommunications (Spectrum Re-allocation) Declaration No. 1 of 2005 as follows.

1. Name of Declaration
This Declaration is the Radiocommunications (Spectrum Re-allocation) Declaration
No. 1 of 2005 (Amendment No. 1 of 2006).
2. Commencement
This Declaration commences on the day after it is registered on the Federal Register of Legislative Instruments.
3. Amendments
The Schedules amend the Radiocommunications (Spectrum Re-allocation) Declaration No. 1 of 2005 (the principal Declaration).
Schedule A (clause 3)
Item 1. Paragraph 4(3)(b) of the principal Declaration:
Replace with:
“(b) ends at midnight on 31 December 2007.”
Item 2. Subsection 4(4) of the principal Declaration:
Replace with:
“(4) For subsection 153B(5) of the Act, the re-allocation deadline for this Declaration is midnight on 31 December 2006.”
Item 3. Schedule 1 of the principal Declaration:
Replace with Schedule B of this instrument.

Description of designated areas
A designated area is an area bounded by a notional line starting at the intersection of the first map grid coordinates listed in a following table and passing sequentially through the intersection of each following set of coordinates in the table to the point where the line started.
