The Australian Communications and Media Authority makes the following determination under subsection 7(1) of the Radiocommunications (Spectrum Licence Tax) Act 1997.

1  Name

This is the Radiocommunications (Spectrum Licence Tax) Amendment Determination 2023 (No. 1).

2  Commencement

This instrument commences at the start of the day after the day it is registered on the Federal Register of Legislation.

Note:    The Federal Register of Legislation may be accessed free of charge at Authority

This instrument is made under subsection 7(1) of the Radiocommunications (Spectrum Licence Tax) Act 1997.

4  Amendments

The instrument that is specified in Schedule 1 is amended as set out in the applicable items in that Schedule.

Schedule 1—Amendments

Radiocommunications (Spectrum Licence Tax) Determination 2021 (F2021L01256)

1Clause 2 of Schedule 1 (table item 9)

Omit the item, substitute:

9 3400 MHz to 3800 MHz 400 MHz 221,376

2  Clause 1 of Schedule 2 (definition of total annual EME Component)

Omit the definition (including the note), substitute:

total annual EME Component means, for the 2023-2024 financial year, $2,014,000.

Note:          For later financial years, the ACMA must increase the total annual EME Component (see subsection 7(2) of the Australian Communications and Media Authority (Modifications to Apparatus and Spectrum Licences Taxes) Direction 2020). That direction is available, free of charge, from the Federal Register of Legislation at Clause 2 of Schedule 2 (example)
