Radiocommunications (Spectrum Licence Tax) Amendment Determination 2018 (No. 1)

The Australian Communications and Media Authority makes the following amendment under subsection 7(1) of the Radiocommunications (Spectrum Licence Tax) Act 1997.

1  Name

This is the Radiocommunications (Spectrum Licence Tax) Amendment Determination 2018 (No. 1).

2  Commencement

This instrument commences at the start of the day after it is registered on the Federal Register of Legislation.

This instrument is made under subsection 7(1) of the Radiocommunications (Spectrum Licence Tax) Act 1997.

4  Amendments

The instrument that is specified in Schedule 1 is amended as set out in the applicable items in that Schedule.

Schedule 1—Amendments

Radiocommunications (Spectrum Licence Tax) Determination 2014 (F2014L00957)

1  Subsection 5(1)

Omit “subsections (2) and (3)”, substitute “subsection (3)”.

2  Subsection 5(2)

Repeal the subsection.

3  Table 1 in Part 1 of Schedule 1 (including the note)

Repeal the table, substitute:

Note:       Each frequency range in column 1 comprises either or both:

(a) a part of the spectrum designated to be allocated by issuing spectrum licences, in a written notice given to the ACMA under subsection 36(1) of the Radiocommunications Act 1992;

(b) a part of the spectrum declared to be subject to re-allocation by issuing spectrum licences, under subsection 153B(1) of the Radiocommunications Act 1992;

regardless of whether the written notice or declaration is still in force.

4  Part 3 of Schedule 1, definition of area population

Omit “2011”, substitute “2016”.

5  Part 3 of Schedule 1, definition of Australian population

Omit “2011”, substitute “2016”.
