I, RICHARD KENNETH ROBERT ALSTON, Minister for Communications and the Arts, under subsection 36 (1) of the Radiocommunications Act 1992, designate the following parts of the spectrum to be allocated by issuing spectrum licences:

(i)    0.40000 MHz in the frequency band between 500.99375 MHz and 501.39375 MHz throughout Australia except for those parts of Australia bounded by the co-ordinates specified in the Schedule to the Radiocommunications (Spectrum Designation) Notice No. 1 of 1996 (Amendment No. 1 of 1999);

(ii)    3.60000 MHz in the frequency band between 501.39375 MHz and 504.99375 MHz in those parts of Australia bounded by the co‑ordinates specified in the Schedule to this Notice;

(iii)    0.40000 MHz in the frequency band between 510.99375 MHz and 511.39375 MHz throughout Australia except for those parts of Australia bounded by the co-ordinates specified in the Schedule to the Radiocommunications (Spectrum Designation) Notice No. 1 of 1996 (Amendment No. 1 of 1999); and

(iv)    3.60000 MHz in the frequency band between 511.39375 MHz and 514.99375 MHz in those parts of Australia bounded by the co‑ordinates specified in the Schedule to this Notice.

In this Notice, the range of numbers that identifies a frequency band includes the higher, but not the lower, number.

Note 1

The Radiocommunications (Spectrum Designation) Notice No. 1 of 1996 (in force under subsection 36 (1) of the Radiocommunications Act 1992) as shown in this compilation is amended as indicated in the Tables below.

Under the implementation of the Legislative Instruments Act 2003, which came into force on 1 January 2005, it is a requirement for all legislative instruments to be registered to the Federal Register of Legislative Instruments.  Any legislative instrument made on or after 1 January 2005 is not enforceable unless it is registered.
