1 Name of Determination [see Note 1]
This Determination is the Radiocommunications (Spectrum Access Charge) Determination 2000.
2 Commencement [see Note 1]
This Determination commences on the day following the day on which it is made.
3 Application of Determination
This Determination applies in relation to a spectrum licence that authorises the operation of a radiocommunications device at frequencies in the
2302–2400 MHz frequency band.
4 Definitions
In this Determination:
Act means the Radiocommunications Act 1992.
MDS licence means an apparatus licence for a multipoint distribution system within the meaning of the Multipoint Distribution System Frequency Band Plan 2000.
population of the licence area
, for a spectrum licence, means the number
of people in the area to which the spectrum licence relates, worked out on the basis of information published by the Australian Bureau of Statistics for the 1991 Census.
radiodetermination licence has the meaning given by the Radiocommunications (Definitions) Determination 1993 (No. 2).
5 When spectrum access charge is payable
Spectrum access charge to which this Determination applies is payable on the issue of the spectrum licence to which the charge relates.
6 Spectrum access charge — replacement of radiodetermination licence of Defence Department
The amount of spectrum access charge that is payable by the Department of Defence for the issue of a spectrum licence to replace the radiodetermination licence held by that Department is $110 822.
7 Spectrum access charge — replacement of MDS licences
(1) This section applies to the issue of a spectrum licence to replace 1, or more than 1, MDS licence held by a person mentioned in column 2 of an item in the following table:

(2) The amount of spectrum access charge payable by a person mentioned in column 2 of an item in the table for the spectrum licence is worked out using the following steps:
Step 1 Multiply the population of the licence area by the bandwidth of the spectrum licence.
The result is amount 1.
Step 2 For each spectrum licence that is offered under section 56 of the Act to replace 1, or more than 1, MDS licence held by a person mentioned in the item, multiply the population of the licence area by the bandwidth of the spectrum licence.
Add up the figures obtained for each spectrum licence offered to any person mentioned in the item.
The result is amount 2.
Step 3 Divide amount 1 by amount 2.
The result is amount 3.
Step 4 Multiply amount 3 by the amount mentioned in column 3 of the item.
The result is the amount of spectrum access charge payable for the spectrum licence.
