  1. Name of Standard [see Note 1]

This Standard is the Radiocommunications (MF and HF Radiotelephone Equipment — International Maritime Mobile Service) Standard 2002.

  1. Commencement [see Note 1]

This Standard commences on gazettal.

  1. Application

(1)   This Standard applies to a radiocommunication device:

(a)    that is MF and HF radiotelephone equipment used in the international maritime mobile service; and

(b)    that is not a device mentioned in subsection (2).

Exception — device imported for significant event

(2)   This subsection applies to a radiocommunications device that:

(a)    is imported in Australia solely for use in connection with a significant event; and

(b)    if required to be tested or inspected before it is used in Australia — meets the testing or inspection requirements; and

(c)    if conditions or requirements are imposed on the use of the device in Australia — complies with those conditions or requirements; and

(d)    is used in Australia only at the location of the significant event; and

(e)    is used in Australia only for the duration of the significant event.

(3)   In this section:

significant event means an event at a specified location or locations, notified on the website with the approval of the Chair.

  1. Standard for performance

(1) For paragraph 162 (1) (a) of the Radiocommunications Act 1992, and subject to subsections (2), (3) and (4), the standard for performance is the standard set out in AS/NZS 4582:1999 (the AS/NZ Standard), as in force from time to time, other than the following provisions:

(a)    from gazettal:

(i)    subclause 4.1.1 (Design);

(ii)    subclause 4.1.2 (Inspection and maintenance);

(iii)    subclause 4.1.3 (Illumination);

(iv)    subclause 4.1.5 (Digital input panels);

(v)    subclause 4.2.1 (General);

(vii)    subclause 4.2.11 (Control panel priority);

(viii)    subclause 4.3.4 (Manufacturer);

(ix)    subclause 4.3.5 (Compass safe distance);

(x)    subclause 4.7.4 (Delay);

(xi)    subclause 4.8 (Instructions);

(xii)    subclause 5.7.1 (Measurement uncertainty);

(xiii)    subclause 5.7.2 (Interpretation of measurement results);

(xiv)    clause 6 (Environmental tests);

(xv)    subclause 7.4 (Unwanted frequency modulation);

(2)   Subclause 7.2.3 of the AS/NZ Standard is modified by adding, after the words ‘subclause 7.2.1.’ the words ‘For Class 2 equipment this limit applies for frequencies up to 17 MHz.  For frequencies above 17 MHz, a tolerance of ± 50 Hz applies.’.

(3)   The heading of subclause 7.8.3 of the AS/NZ Standard is modified by adding, after the word ‘Limits’, the words ‘¾ Class 1 equipment’.

(4)   Subclause 7.8.3 of Annex ZZ of the AS/NZ Standard is modified by omitting the words ‘Replace the text and Figure 3 with the following:’, and substituting the words ‘For Class 2 equipment:’.

  1. Effect of amendment of standard for performance

(1)   If a radiocommunications device is manufactured, imported, altered or modified less than 1 year after the standard for performance is amended, the device is taken to meet the standard for performance if it meets that standard as in force before the amendment.

(2)   A radiocommunications device that is manufactured, imported, altered or modified 1 year or more after the standard for performance is amended must meet the standard for performance as amended.

Note 1

The Radiocommunications (MF and HF Radiotelephone Equipment — International Maritime Mobile Service) Standard 2002 (in force under subsection 162 (1) of the Radiocommunications Act 1992) as shown in this compilation is amended as indicated in the Tables below.

Under the Legislative Instruments Act 2003, which came into force on 1 January 2005, it is a requirement for all non-exempt legislative instruments to be registered on the Federal Register of Legislative Instruments.
