Radiocommunications (Licensing and General) Regulations2 (Amendment)

Commencement

1. These Regulations shall come into operation on 1 December 1987.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Radiocommunications (Licensing and General) Regulations.

Interpretation

3. Regulation 2 of the Principal Regulations is amended:

(a) by inserting before the definition of “aeronautical mobile service” in subregulation (1) the following definition:

“‘ambulatory service’ means a mobile service consisting wholly of ambulatory stations;”;

(b) by omitting paragraph (b) of the definition of “amateur station” in subregulation (1) and substituting the following paragraph:

 

“(b) that includes a transmitter, or transmitters, used subject to the conditions prescribed under Part III in relation to a licence in respect of a transmitter;”;

(c) by omitting from the definition of “AUSSAT receive-only station” in subregulation (1) “Item 20, 21, 22, 23, 24 or 25” and substituting “Item 22, 23, 24, 25, 26 or 27”;

(d) by omitting from subregulation (1) the definition of “extra high density location” and substituting the following definition:

“‘extra high density location’ means a location situated within 80 kilometres of the General Post Office, Sydney, in the State of New South Wales;”;

(e) by omitting from subregulation (1) the definition of “high density location” and substituting the following definition:

“‘high density location’ means a location situated:

(a) within 30 kilometres of the Post Office, Newcastle, in the State of New South Wales;

(b) within 30 kilometres of the Post Office, Wollongong, in the State of New South Wales (other than a location so situated that is an extra high density location);

(c) within 30 kilometres of the Post Office, Geelong, in the State of Victoria (other than a location so situated that is a very high density location);

(d) within 35 kilometres of the Post Office, Surfers Paradise, in the State of Queensland;

(e) within 30 kilometres of the General Post Office, Adelaide, in the State of South Australia; or

(f) within 30 kilometres of the General Post Office, Perth, in the State of Western Australia;”;

(f) by inserting after the definition of “land mobile service” in subregulation (1) the following definition:

“‘land mobile system service’ means a land mobile service comprising a base station and any number of mobile stations;”;

(g) by omitting from subregulation (1) the definition of “low density location” and substituting the following definition:

“‘low density location’ means a location other than a high density location or very high density location or an extra high density location;”;

(h) by omitting from subregulation (1) the definition of “multipoint distribution station”;

(i) by omitting from subregulation (1) the definition of “narrowband area receiver” and substituting the following definitions:

“‘narrowband area receiver’ means a receiving station in the narrowband area service;

‘narrowband area service’ means a radiocommunications service between a land station operating on a bandwidth not exceeding 4 megahertz and 2 or more receivers;”;

(j) by omitting from subregulation (1) the definition of “network”;

(k) by omitting from subregulation (1) the definition of “outside broadcast television service” and substituting the following definition:

“‘outside broadcast television service’ means a radiocommunications service:

(a) operating:

(i) at a frequency exceeding one gigahertz; and

(ii) between 2 points for short periods of time in accordance with arrangements made under the relevant licence; and

(b) used only for the transmission of information associated with particular events;”; and

(l) by adding at the end of subregulation (1) the following definition:

“‘very high density location’ means a location situated:

(a) within 65 kilometres of the General Post Office, Melbourne, in the State of Victoria; or

(b) within 40 kilometres of the General Post Office, Brisbane, in the State of Queensland.”.

Installation, etc., of station or service

4. Regulation 12 of the Principal Regulations is amended by omitting “, service or network” (wherever occurring) and substituting “or service”.

Schedule 1

5. Schedule 1 to the Principal Regulations is repealed and the following Schedule substituted:

An amateur station in the case where the holder of the transmitter licence that relates to the station is a person to whom a certificate of proficiency has been granted in relation to the Limited Amateur Operator’s Examination referred to in regulation 5 of the Radiocommunications (Certificates of Proficiency) Regulations.

Amateur station (novice)

An amateur station in the case where the holder of the transmitter licence that relates to the station is a person to whom a certificate of proficiency has been granted in relation to the Novice Amateur Operator’s Examination referred to in regulation 6 of the Radiocommunications (Certificates of Proficiency) Regulations.

Amateur station (combined limited and novice)

An amateur station in the case where the holder of the transmitter licence that relates to the station is a person to whom a certificate of proficiency has been granted in relation to:

(a) the Limited Amateur Operator’s Examination referred to in regulation 5; and

(b) the Novice Amateur Operator’s Examination referred to in regulation 6;

of the Radiocommunications (Certificates of Proficiency) Regulations.

Ambulatory service (extra high density location)

An ambulatory service that operates in an extra high density location.

Ambulatory service (very high density/high density location)

An ambulatory service that operates in a very high density location or a high density location.

Ambulatory service (low density location)

An ambulatory service that operates in a low density location.

AUSSAT service

A service comprising earth stations possessed and operated by AUSSAT Proprietary Limited in the provision of radiocommunication services.

Australian satellite service

A service consisting of a space satellite declared by these Regulations to be an Australian satellite for the purposes of the Act.

Base station, Class I

A base station, not being a base station, Class III, that uses, for transmission purposes, a single frequency not exceeding 30 megahertz.

A station that employs, for radiocommunication, any frequency included in the frequencies designated in the frequency table as a frequency for use by citizen band radio stations.

Coast station, Class A

A coast station other than a coast station, Class B, that is used for communicating with ship stations on very high frequency channels.

Coast station, Class B

A coast station that is used for communicating with ship stations on other channels in addition to, or instead of, very high frequency channels.

Disaster station

A station having the exclusive function of providing a radiocommunications service in relation to natural disasters and civil defence activities.

Earth station, Australian satellite service

An earth station, other than an earth station in the AUSSAT service, that is established for the purpose of providing access to an Australian satellite.

Earth station, Class A

An earth station, other than an earth station, Australian satellite service, or an earth station in the AUSSAT service, capable of carrying not more than one voice channel.

Earth station, Class B

An earth station, other than an earth station, Australian satellite service, or an earth station in the AUSSAT service, capable of carrying more than one but not more than 12 voice channels.

An exterior paging service that operates in a location other than a low density location.

Exterior paging service (low density location)

An exterior paging service that operates in a low density location.

Exterior paging service (supplementary transmitter, other than low density location)

A station that includes a transmitter:

(a) that is used in conjunction with a transmitter operating in an exterior paging service (other than low density location);

(b) that operates within a 40 km radius of that last-mentioned transmitter; and

(c) that is used in a location other than a low density location.

Exterior paging service (supplementary transmitter, low density location)

A station that includes a transmitter:

(a) that is used in conjunction with:

(i) a transmitter operating in an exterior paging service (other than low density location), and that is located within a 40 km radius of that last-mentioned transmitter; or

(ii) a transmitter operating in an exterior paging service (low density location), and that is located with an 80 km radius of that last-mentioned transmitter; and

(b) that is used in a low density location.

Fixed station, Class A (business)

A fixed station:

(a) that uses, for transmission purposes, a single frequency below 30 megahertz; and

(b) that is used for the transmission of business messages.

(iii) telecommand; and

(c) that is used in a low density location.

A fixed station, other than a fixed station, Class B:

(a) that uses, for transmission purposes, a single frequency exceeding 30 megahertz but not exceeding one gigahertz; and

(b) that is used in a location other than a low density location.

A fixed station, other than a fixed station, Class B:

(a) that uses, for transmission purposes, a single frequency exceeding 30 megahertz but not exceeding one gigahertz; and

(b) that is used in a low density location.

A station, being a station not otherwise referred to in this Schedule, that uses, for transmission purposes:

(a) an occupied bandwidth not exceeding 500 kilohertz; or

(b) a transmitter power not exceeding 10 watts.

A station, being a station not otherwise referred to in this Schedule, that uses, for transmission purposes:

(a) an occupied bandwidth not exceeding 3,000 kilohertz; or

(b) a transmitter power not exceeding 100 watts.

A station that:

(a) comprises equipment that is suitable for carriage by hand or on the person; and

(b) employs, as specified in the licence, one or more of the following frequencies: 27,230, 27,240, 27,250, 27,260, 27,270, 27,280, 27,550, 27,560, 27,580, 27,590, 27,620, 27,660, 27,760 kilohertz.

Interior paging service

A radiocommunications service:

(a) that comprises:

(i) a single transmitter; and

(ii) one or more than one receiver suitable for carriage by hand or on the person; and

(b) that is used for communication solely within premises or similar restricted areas.

Internal television service

A low-powered radiocommunications service that links parts of a closed-circuit television installation within premises or any similar restricted area.

Land mobile system service (extra high density location)

A radiocommunications service:

(a) that:

(i) operates in association with any number of mobile stations; or

(ii) has been operating as part of a trunked land mobile service for a period of not less than 3 years;

(b) that uses a frequency channel, or frequency channels:

(i) not currently allocated for use under another transmitter licence; and

(ii) not previously allocated for use under another transmitter licence held by the holder of the licence in respect of the relevant land mobile system service; and

(c) that is used in an extra high density location.

Land mobile system service (very high density location)

A radiocommunications service:

(a) that:

(i) operates in association with any number of mobile stations; or

(ii) has been operating as part of a trunked land mobile service for a period of not less than 3 years;

(b) that uses a frequency channel or frequency channels:

(c) that is used in a very high density location.

Land mobile system service (special)

A land mobile system service including any number of mobile stations on land, not being a land mobile system service (extra high density location) or a land mobile system service (very high density location).

Land mobile system service (supplementary transmitter)

A station that includes a transmitter:

(a) that is used in conjunction with a land mobile system service; and

(b) that operates on the same frequency and in the same service area as that service.

Limited coast station

A coast station (other than a marine rescue station):

(a) that is not used:

(i) for communicating with aircraft stations; or

(ii) for the transmission and reception of messages on behalf of the pubic; and

(b) that uses, for transmission purposes:

(i) one or more of the following carrier frequencies: 1,715, 1,725, 1,775, 2,008, 2,032, 2,112, 2,182, 2,436, 2,524, 4,125, 4,535, 4,620, 6,215.5, 27,680, 27,720, 27,820, 27,860, 27,880, 27,900, 27,910, 27,940, 27,980, 156,375, 156,425, 156,450, 156,500, 156,550, 156,575, 156,600, 156,650, 156,675, 156,700, 156,725, 156,800, 157,375, 161,525, 161,575, 161,600 kilohertz; or

(ii) any single frequency other than one of those frequencies.

Marine rescue station

A station (other than a mobile (disaster plan) station) that:

(a) is operated:

(i) by a body in relation to which the Minister certifies that the Minister is satisfied that body is prepared to provide a comprehensive emergency radiocommunications service to vessels at sea without discrimination; or

(ii) aboard a ship by a person acting on behalf of, or in co-ordination with, such a body;

(b) is used primarily for ship-to-shore, shore-to-ship and intership communications;

(c) in the case of a station established on land:

(i) maintains a listening watch on the frequency 27,880 kilohertz and on either or both of the frequencies, 2,182 kilohertz and 156.8 megahertz; and

(ii) transmits on the frequency 27,860 kilohertz and:

(A) where it maintains a listening watch on the frequency 2,182 kilohertz—transmits on the frequency 2,524 kilohertz; and

(B) where it maintains a listening watch on the frequency 156.8 megahertz—transmits on the frequency 156.375 megahertz; and

(d) in the case of a station established aboard a ship, operates:

(i) on the frequencies 27,860 and 27,880 kilohertz; and

(ii) on either or both of the following pairs of frequencies:

(A) 2,182 and 2,524 kilohertz;

(B) 156.375 and 156.8 megahertz.

Mobile (disaster plan) station

An ambulatory station that:

(a) is authorised by the Minister to participate in an emergency radiocommunications service that is established or maintained in accordance with an agreement between the Commonwealth and either a State or the Northern Territory, being an agreement declared by the Minister, by notice published in the Gazette, to be an approved agreement for the purposes of this description; and

(b) is also authorised by the Minister to be used as if it were:

(i) an aircraft station, Class A or an aircraft station, Class B;

(ii) a marine rescue station;

Mobile outpost station

A mobile station that forms part of the outpost service.

Mobile station

An ambulatory station other than an ambulatory station of a kind specified in this Schedule.

Multipoint distribution station

A station that includes a transmitter providing a one way radiocommunication of television or broadband data to multipoint distribution station receivers located at fixed points.

Multipoint distribution repeater station

A station:

(a) that is used for the reception and automatic retransmission of radio transmissions emanating from a multipoint distribution station;

(b) that employs an effective isotropically radiated power not exceeding 5 watts; and

(c) that has a coverage area that does not extend beyond that of the station referred to in paragraph (a).

Narrowband area station, Class A

A land station in the narrowband area service:

(a) that does not include a receiver; and

(b) that operates on a frequency not exceeding one gigahertz.

Narrowband area station, Class B

A land station in the narrowband area service:

(a) that does not include a receiver; and

(b) that operates on a frequency exceeding one gigahertz.

Outpost station

A land station in the outpost service.

Outside broadcast television station

A station in the outside broadcast television service.

Radiodetermination station (high power)

A station in which the mean power fed to the antenna exceeds one watt, being a station that is used for:

(a) the determining, in relation to objects, of any of the following parameters: their positions, velocities and other characteristics; and

(b) the obtaining of information in relation to those parameters;

by means of the propagation properties of radio waves.

Radiodetermination station (low power)

A station in which the mean power fed to the antenna does not exceed one watt, being a station that is used for:

(a) the determining, in relation to objects, of any of the following parameters: their positions, velocities and other characteristics; and

(b) the obtaining of information in relation to those parameters;

by means of the propagation properties of radio waves.

Remote control station

A station that is established at a fixed location for the remote control of a land station, or land stations, used for communicating with mobile stations, being a station:

(a) transmitting and receiving on the same frequency, being the frequency; or

(b) transmitting and receiving on 2 different frequencies, being the frequencies;

used by the land station or land stations to communicate with the mobile stations used in association with the land station or land stations.

Repeater station

A station established at a fixed location for the reception of radio signals from amateur stations or citizen band radio stations and for the automatic retransmission of those signals by radio.

Repeater station (passive)

A station erected expressly for purposes of radiocommunication consisting of:

(a) a reflector used to change the direction of propagation of a microwave beam; or

(b) two antennas connected by a transmission line, being one antenna used to receive signals in the form of incident radiation and the other to transmit such signals in a new direction.

Ship station, Class A

A ship station, other than a ship station, Class C, used by a member of an organisation established to provide an inshore boating service, not being a station that includes a transmitter licensed to transmit public correspondence.

Ship station, Class B

A ship station other than a ship station, Class C:

(a) that includes a transmitter licensed to transmit public correspondence; or

(b) that does not include such a transmitter so licensed and that is not a ship station, Class A.

Telemetry service (other than low density location)

A radiocommunications service between a central station and remote stations:

(a) that employs, for transmission purposes, a single frequency exceeding 30 megahertz and an occupied maximum bandwidth not exceeding 16 kilohertz;

(b) that is used, with or without telecommand facilities, for the purposes of telemetry; and

(c) that is used in a location other than a low density location.

Telemetry service (low density location)

A radiocommunications service between a central station and remote stations:

(a) that employs, for transmission purposes, a single frequency exceeding 30 megahertz and an occupied maximum bandwidth not exceeding 16 kilohertz;

(b) that is used, with or without telecommand facilities, for the purposes of telemetry; and

(c) that is used in a low density location.
