Radiocommunications (Licensing and General) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Radiocommunications Act 1983.

Commencement

1. These Regulations commence on 1 December 1989.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Radiocommunications (Licensing and General) Regulations.

Interpretation

3. Regulation 2 of the Principal Regulations is amended:

(a) by inserting “or aircraft stations” after “ship stations” in the definition of “coast station, Class A (receive only)” in subregulation (1);

(b) by inserting “or aircraft stations” after “ship stations” in the definition of “coast station, Class B (receive only)” in subregulation (1);

(c) by omitting “from fixed stations” from the definition of “receiving land station” in subregulation (1);

 

(d) by inserting in subregulation (1) the following definition:

“‘service area’ has the same meaning as in the Broadcasting Act 1942;.

Fee for examination for the purposes of section 12 of the Act

4. Regulation 4 of the Principal Regulations is amended by adding at the end the following subregulations:

“(5) Where a device, submitted for examination for the purposes of section 12 of the Act in respect of a standard:

(a) is both a receiver and a transmitter and:

(i) only that part of the device that is a receiver is submitted for examination; or

(ii) only that part of the device that is a transmitter is submitted for examination; or

(b) is a receiver only; or

(c) is a transmitter only;

the fee payable for the examination is an amount equal to 60% of the amount of the fee specified in Schedule 2 for examination in respect of that standard.

“(6) Subregulation (5) does not apply where the standard in respect of which the device is to be examined is a standard which relates to a device which is a receiver only or is a transmitter only.

“(7) Where:

(a) upon the examination of a device for the purposes of section 12 of the Act in respect of a standard, the Minister refuses to issue a compliance statement certificate; and

(b) the device is resubmitted for further examination within a period of 6 months after the day on which any previous examination of the device against that standard was completed;

the fee payable for a second or any subsequent examination is 50% of the amount of the fee payable for the first examination in respect of that standard.

“(8) Subregulation (7) does not apply to a second or any subsequent examination where there is included in that examination any part of the relevant device that was not submitted for a previous examination.”.

Fee in respect of tests conducted under section 15a of the Act

5. Regulation 4aof the Principal Regulations is amended:

(a) by omitting from paragraph (5) (b) “70%” and substituting “60%”;

(b) by inserting after subregulation (5) the following subregulation:

“(5a)Where a device submitted for testing, for the purposes of section 15aof the Act is:

(a) a receiver only; or

 

(b) a transmitter only;

the fee payable in respect of that testing is an amount equal to 60% of the fee specified in Column 3 in Schedule 2ain relation to a device which includes a receiver or transmitter of that type, as the case may be.”;

(c) by adding at the end the following subregulation:

“(7) Subregulation (6) does not apply to a second or any subsequent testing where there is included in that testing any part of the relevant device that was not submitted for a previous testing.”.

Prescribed classes of transmitters

6. Regulation 6 of the Principal Regulations is amended:

(a) by omitting paragraph (a) and substituting the following paragraph:

“(a) the classes of transmitters that comply with any of standards 241, 302, 306 or 315;”;

(b) by adding at the end the following paragraphs:

“(c) the class of transmitters comprising transmitters:

(i) which, immediately before 1 December 1989, were located in Australia and were included in a prescribed class of transmitters under paragraph (b) as in force immediately before 1 December 1989; and

(ii) which, but for this provision, would not be included in a prescribed class of transmitters on or after 1 December 1989;

(d) the class of transmitters comprising transmitters operating at a frequency of 10500 to 10550 MHz (inclusive) where the field strength of a transmission on a carrier frequency does not exceed 115 dBuV/m at 3 metres from the antenna.”.

Conditions in relation to operation of amateur station

7. Regulation 16 of the Principal Regulations is amended by omitting from paragraph (c) “on any frequency lower than 50 megahertz”.

Schedule 1

8. Schedule 1 to the Principal Regulations is amended:

(a) by inserting after item 7 the following item:

“7a

Ambulatory service (low frequency)

An ambulatory service that operates on a single frequency not exceeding 30 MHz.”;

(b) by inserting in Column 3 of item 8 “on a single frequency exceeding 30 MHz” after “that operates”;

(c) by inserting in Column 3 of item 9 “on a single frequency exceeding 30 MHz” after “that operates”;

(d) by inserting in Column 3 of item 10 “on a single frequency exceeding 30 MHz” after “that operates”;

 

(e) by inserting in Column 3 of item 19 “or aircraft stations” after “ship stations”;

(f) by inserting in Column 3 of item 20 “or aircraft stations” after “ship stations”;

(g) by omitting from paragraph (b) in Column 3 of item 57 “frequency channel, or frequency channels” and substituting “single frequency channel”;

(h) by omitting from paragraph (b) in Column 3 of item 58 “frequency channel, or frequency channels” and substituting “single frequency channel”;

(i) by inserting in Column 3 of item 61 “156,300,” after “27,980,”.

Schedule 2

9. Schedule 2 to the Principal Regulations is repealed and the following Schedule substituted:
