Radiocommunications (Licensing and General) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Radiocommunications Act 1983.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Radiocommunications (Licensing and General) Regulations.

Interpretation

2. Regulation 2 of the Principal Regulations is amended by omitting from subregulation (1) the definitions of “land mobile service” and “narrowband area service” and substituting the following definitions:

“‘land mobile service’ means a radiocommunications service that is used principally for the purpose of the transmission of messages to and from ambulatory stations on land, not being:

(a) an exterior paging service;

(b) an interior paging service;

(c) a narrowband area service; or

(d) a part of a service referred to in paragraph (a), (b) or (c);

‘narrowband area service’ means a one-way radiocommunications service:

(a) between a narrowband area station and narrowband area receivers; and

(b) that is not an exterior paging service or an interior paging service;

‘narrowband area station’ means a station that:

(a) provides one-way radio transmission to not less than 4 narrowband area receivers; and

(b) uses an occupied bandwidth not exceeding 4 megahertz.”.

Schedule 1

3. Schedule 1 to the Principal Regulations is amended:

(a) by omitting item 22 and substituting the following items:

“22 Earth station, Australian satellite service, Class A

An earth station, other than an earth station in the AUSSAT service, the operator of which has entered into an agreement with the Commonwealth for the purpose of providing video entertainment services by means of the earth station.

22a Earth station, Australian satellite service, Class B

An earth station, other than an earth station in the AUSSAT service or an earth station, Australian satellite service, Class A, that is established for the purposes of providing access to an Australian satellite.”;

(b) by omitting items 68 and 69 and substituting the following items:

“68 Narrowband area station, Class A

A narrowband area station that operates on a single frequency not exceeding 1 gigahertz.

69 Narrowband area station, Class B

A narrowband area station that operates on a single frequency that exceeds 1 gigahertz.”.
