Radiocommunications Licence Fees Regulations (Amendment) (Cth)

of the Federal Executive Council, hereby make the following Regulations under
the

Licence fees
(a) by inserting in sub-regulation (1)“or referred to” after “rate specified”; and
(b) by omitting sub-regulations (3) and (4).
“3a. (1) The succeeding provisions of this regulation apply in ascertaining the rate of the fee payable in respect of the grant or renewal of a licence included in the class of licences referred to in Item 32 in the Schedule.
“(2) The rate of the fee referred to in sub-regulation (1) is an amount per year, being—
(a) in the case of a fixed station, Class C, having one or more transmitting frequencies each of which has an occupied bandwidth not exceeding 10000 kilohertz—an amount, or an amount equal to the aggregate of the amounts, as the case requires, ascertained in accordance with sub-regulation (3) in respect of each such bandwidth;
(b) in the case of such a station having one or more transmitting frequencies each of which has an occupied bandwidth exceeding 10000 kilohertz—an amount ascertained in accordance with sub-regulation (4) in respect of the aggregate of the bandwidths of each such frequency; and
(c) in the case of such a station having transmitting frequencies of the kinds referred to in sub-paragraphs (a) and (b)—an amount equal to the aggregate of the amounts ascertained in accordance with each of those sub-paragraphs.
“(3) Where the bandwidth occupied by a transmitting frequency of a fixed station, Class C referred to in paragraph (2) (a) is within a range specified in Column 2 of an item in the table, the amount ascertained for the purposes of that paragraph is
(a) in the case of such a station in a high density location—the amount specified in Column 3 of that item; and
(b) in the case of such a station in a low density location—the amount specified in Column 4 of that item:

“(4) Where the aggregate of the bandwidths occupied by each transmitting frequency of a fixed station, Class C referred to in paragraph (2) (b) is within a range specified in Column 2 of an item in the table, the amount ascertained for the purposes of that paragraph is—
(a) in that case of such a station in a high density location—the amount specified in Column 3 of that item; and
(b) in the case of such a station in a low density location—the amount specified in Column 4 of that item:

“(5) In sub-regulations (3) and (4)—
‘high density location’ has the same meaning as in the Wireless Telegraphy Regulations;
‘low density location’ means a location other than a high density location.”.
(a) by omitting “Item 21 or Column 2 of Items 25 to 32 (inclusive)” from the definition of “relevant licence” in sub-regulation (1) and substituting “Item 25 or Column 2 of Item 32”;
(b) by omitting from sub-regulation (3) “Item 21” and “Items 25 to 32 (inclusive)” and substituting “Item 25” and “Item 32” respectively; and
(c) by omitting from sub-regulation (5) “Item 21” and “Items 25 to 32 (inclusive)” and substituting “Item 25” and “Item 32” respectively.
