417 Quanslaub ANNO VICESIMO SEPTIMO ELIZABETHAE SECUNDAE REGINAE No. 52 of 1978 An Act to amend the Radioactive SubstancesAct 1958-1970 in certain particulars [ ASSENTED TO 22ND AUGUST, 1978] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Radioactive Substances Act Amendment Act 1978. (2) In this Act the Radioactive Substances Act1958-1970 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Radioactive Substances Act1958-1978. 2. Commencement of Act. This Act shall commence on a date to be fixed by Proclamation. 3. Repeal of and new s.14. The Principal Act is amended by repealing section 14 and substituting the following section:- " 14. Possession and use of irradiating apparatus . (1) Subject to such exemptions as may be prescribed a person shall not have in possession irradiating apparatus unless he is the holder of a licence that authorizes him to use or have in possession irradiating apparatus and his possession of irradiating apparatus complies with the conditions of that licence.
418 Radioactive Substances Act Amendment Act 1978, No. 52 Penalty-$400 or six months imprisonment or both such penalty and imprisonment. Daily penalty-$20. (2) Subject to such exemptions as may be prescribed a person shall not sell irradiating apparatus, unless he is the holder of a licence that authorizes him to sell irradiating apparatus and his sale of irradiating apparatus complies with the conditions of that licence. Penalty-$400 or six months imprisonment or both such penalty and imprisonment. Daily penalty-$20. (3) Subject to such exemptions as may be prescribed a person shall not use irradiating apparatus unless he is the holder of a licence that authorizes him to use irradiating apparatus and his use of irradiating apparatus complies with the conditions of that licence. Penalty-$400 or six months imprisonment or both such penalty and imprisonment. Daily penalty-$20.".
